The Article 191- 2 of Civil Code mentions the driver shall be liable for the injury of car accidents. However, when the autonomous car reaches level 4, it can not only “help” human beings make decisions, but decides itself. On the other hand, the person behind the wheel loses abilities to control the car, in this situation is he or she still a driver? Many literatures depict that while considering the legal framework of autonomous vehicles, it prefers the term of “operator” instead of “driver”. Thus, the liability of the person behind the wheel also changes significantly, for example, the reasonable care for operator might exercise in selection and supervision of autonomous vehicles instead of driving surrounding environment attention. Therefore, in response to the development of future technology, the study provides the legislative framework for the Level 4 autonomous vehicle through the discussion of literature reviews in various countries.
