近年來社會的變遷及法令的修改下,多數勞工可以取得的資訊愈來愈容易,及新聞媒體大量的播報下許許多多的勞資爭議問題浮現抬面,但還是很多小型企業的雇主或是代理雇主管理人是缺乏對於勞資問題的基本常識,尤其是在服務業上認知差異更甚。
本研究最初研究勞資爭議的問題,在勞工的身上會有什麼的行為反應,以提供本研究員在工作上能對於問題發生時處理問題的能力解決能力,在經歷了工作上的更換後發現,中小型企業(泛指未上市櫃之小企業)經營者多數是沒有太多勞動法令的認知,這往往是形成勞資爭議問題的主要原因。
本研究中了解到勞資爭議,對於每一個不同層級的勞工,對於發生勞資爭議時有的不同應對的方式,及在每一個不同年資的勞工身上,亦有不同的結果產生﹔以提供雇主及HR在處理勞資爭議上可以有更圓融的處理方式。
政府單位若能針對中小型企業主的勞動法令加強宣導及教育,方能減少基層勞工被雇主剝削的機會,才能有勞、資雙方和諧的局面。
本研究使用問卷調查方式,以在網路上的朋友及本研究員之同事朋友為抽樣對象,共計回收204份問卷。探討勞工朋友對於十五項勞資爭議問題的行為反應依年齡、職務層級是不是有所差異。
