摘要:	訟師，是一群在法庭編制外，替刑事、民事案件中的當事者，進行訴訟的人。他們不被官方認同，甚至是政府官員口誅筆伐的對象，卻無礙於他們在衙門內外的活躍性，甚至發展到後來，成為左右案情的關鍵角色。訟師一行源來已久，可溯於春秋時期的辯士，爾後曾扮演代書角色，本以代作呈詞（包括寫書狀、訴狀及督促狀）、負責詞訟、與胥吏、差役進行交涉等為主，可協助不識字且無法律常識的百姓處理訴訟糾紛。不過，因訟師良莠不齊，有許多是以助訟為名，而行唆人起訟之實，擾亂官聽，詐財謀利，危害社會秩序。本論文擬從春秋至清代筆記故事中，歷代訟師助訟內容與方式等，探討其角色衍變，與對社會的影響。 Law practitioner, are outside the establishment of the Tribunal, for the criminal, civil parties in the case, persons who carry out the proceedings. In the story of this thesis to be notes from the spring and Autumn period to the Qing dynasty, ancient law practitioner costs and to explore its role in evolution, and impact on society.
