Abstract:	訟師，是一群在法庭編制外，替刑事、民事案件中的當事者，進行訴訟的人。他們不被官方認同，甚至是政府官員口誅筆伐的對象，卻無礙於他們在衙門內外的活躍性，甚至發展到後來，成為左右案情的關鍵角色。訟師一行源來已久，可溯於春秋時期的辯士，爾後曾扮演代書角色，本以代作呈詞（包括寫書狀、訴狀及督促狀）、負責詞訟、與胥吏、差役進行交涉等為主，可協助不識字且無法律常識的百姓處理訴訟糾紛。不過，因訟師良莠不齊，有許多是以助訟為名，而行唆人起訟之實，擾亂官聽，詐財謀利，危害社會秩序。本論文擬從春秋至清代筆記故事中，歷代訟師助訟內容與方式等，探討其角色衍變，與對社會的影響。 Law practitioner, are outside the establishment of the Tribunal, for the criminal, civil parties in the case, persons who carry out the proceedings.
