    Abstract: 都市更新公權力代拆制度一直是社會上引起爭議的議題之一。本研究採用質性方式,旨在深入探討此制度對社會的影響及相關問題。以最具代表性都市更新案例之一的文林苑作為研究對象,透過文獻分析、個案研究及深度訪談方式,試圖解構再結構都市更新公權力代拆制度的運作機制,並探討其在實際案例中引發的社會效應及反餽。
    本研究將聚焦於所有權人、社會團體、政府單位、專家學者、實施者等相關權利關係人的觀點,探討在文林苑事件中都市更新公權力代拆制度成敗之關鍵因素,以全面了解公權力代拆對社會的影響。
    本研究的目的在於深化對都市更新公權力代拆制度的理解,探討分析事件中相關權利人除還原當時事件之情況外,亦對於此制度之操作及看法,藉由頗析此事件來研究分析代拆制度成敗之關鍵因素,希望能透過此研究對於未來在擬定相關政策時期希提供更多資訊,促使都市更新制度代拆制度能夠更加完善,讓台灣都市更新的公共利益與社會公平能更加平衡。

    The urban renewal public power demolition system has always been one of the controversial issues in society. This study adopts a qualitative approach and aims to deeply explore the impact of this system on society and related issues. Taking Wen-Ling Estate, one of the most representative urban renewal cases, as the research object, through document analysis, case studies and in-depth interviews, we try to deconstruct and restructure the operating mechanism of the urban renewal public power demolition system, and explore its application in actual cases. The social effects and feedback caused by it.
    This study will focus on the views of relevant stakeholders such as owners, social groups, government units, experts and scholars, implementers, etc., and explore the key factors in the success or failure of the urban renewal public power demolition system in the Wen-Ling Estate Court incident, in order to comprehensively understand public power The impact of demolition on society.
    The purpose of this study is to deepen the understanding of the urban renewal public power demolition system and explore the relevant rights holders in the incident. In addition to restoring the situation at that time, they also have the operation and views of this system. By analyzing this incident, we can study and analyze the generation. We hope that through this study, we can provide more information on the key factors for the success or failure of the demolition system in the future when formulating relevant policies, so that the urban renewal system can be more perfect and the public interest and social equity of urban renewal in Taiwan can be more balanced.
