    題名: 臺灣少年修復式對話之建構-被害人方的觀點
    The Construction of Restorative Justice among Taiwanese Adolescents - The Victim’s Perspective

    摘要: 本研究旨在針對臺灣少年修復式對話之被害人,了解被害人及其家屬參與修復式對話之歷程。國內外已有諸多研究探討修復式司法對被害人的影響,包括:擁有更多自主權、擁有更多發聲的機會、有機會表達個人想法與感受、獲得道歉並療癒內在、修復關係等。本文以紮根理論之資料分析方法,以及採取 Lieblich「類別—內容」分析法,針對四未未成年被害人及其家屬參與修復式對話之歷程進行編碼與分析,最後彙整出主題,並得出研究結果與討論 。本研究結果於第四章進行個別分析,並作跨個案分析。統整四位被害少年參與修復式對話之歷程分
    析主題包括:(一)描述案件時詳細並重新覺察自身感受;(二)案件所造成自責、後悔與生氣等情緒與感受;(三)案件造成身心負面影響、他人輿論以及家人擔憂;(四)案件的期待為對方誠摯道歉以及有實質的補償;(五)加害人的道歉態度是否誠懇以及補償條件影響到被害人的原諒;(六)其他關於親子關係、個人心理復原歷程等議題。而四組被害少年家屬參與修復式對話之歷程分析主題則包括:(一)案件造成情緒波動與負面感受;(二)對案件的最終期待能撫慰孩子的受傷與損失;(三)加害人的道歉態度是否誠懇將影響到被害人家屬的原諒;(四)其他關於親子關係、校園安全及RJ介入的有效性等議題。本研究結果發現,修復式對話可以提供以下幾方面的益處 :(一)個人想法與情緒的覺察;(二)人與人之間的連結;(三)解決衝突的機會;(四)個人被理解的機會; (五)個人表達需求與期待的機會。最後,研究者針對本研究提出了相關建議和研究限制,並期望能夠為未來的研究方向提供參考與指引。

    This study aims to understand the process of Taiwanese adolescent victims and their families participating in restorative justice. Numerous studies, both domestic and
    international, have explored the impact of restorative justice on victims, including increased autonomy, more opportunities to voice their thoughts and feelings, the chance to express personal ideas and emotions, receiving apologies and inner healing, and relationship restoration. This paper employs grounded theory for data analysis and Lieblich's "Category-Content" analysis method to code and analyze the experiences of four groups of adolescent victims and their families during restorative justice, eventually consolidating themes and deriving research results and discussions. The study results are individually analyzed in Chapter Four, followed by a cross-case analysis. The analysis themes for the restorative justice experiences of the four
    adolescent victims include: (1) Detailed description of the case and re-awareness of personal feelings; (2) Emotional responses such as guilt, regret, and anger caused by the case; (3) The negative physical and mental impacts of the case, public opinion, and family concerns; (4) Expectations for sincere apologies and substantial compensation from the offender; (5) The influence of the offender's sincerity in apology and compensation conditions on the victim's forgiveness; (6) Other issues related to parent-child relationships and personal psychological recovery processes. For the families of
    the four adolescent victims, the analysis themes include: (1) Emotional fluctuations and negative feelings caused by the case; (2) Expectations that the resolution of the case will heal the child's wounds and losses; (3) The influence of the offender's sincerity in apology on the family's forgiveness; (4) Other issues related to parent-child relationships, school safety, and the effectiveness of RJ interventions. The study finds that restorative justice can provide the following benefits: (1) Awareness of personal thoughts and emotions; (2) Connections between individuals; (3) Opportunities to resolve conflicts; (4) Opportunities for personal understanding; (5) Opportunities to express personal needs and expectations. Finally, the researcher proposes relevant
    recommendations and limitations of the study, hoping to provide references and guidance for future research directions.
