Abstract:	本研究以破產財團之管理為核心議題，並針對取回權與撤銷權衍生之相關問題進行研究，探討該規定於實務運作之概況。本研究擬整理最高法院近年相關裁判，以釐清法院針對不同行使取回權之情況所持之看法與考量；而就撤銷權之部分，亦得從法院判決得出准駁之比例與標準。此外，本研究擬從比較法觀點切入，以德國破產法作為主要比較對象，透過介紹該國破產法之規定與學理上相關討論，應能提供我國學者與實務工作者不同的思考方向。
