    Abstract: 「有土斯有財、無田不成富」可說是普遍臺灣人根深蒂固的觀念,擁有一個屬於自己的房子才能擁有某種程度的踏實、歸屬感,同時「買房」也是大多數人一項投資標的,是得以保值、抗通膨的選項之一,也因此買房成為大多數人生命中的重要課題,即便在近年來房價不斷飆漲,購屋的交易量仍保有一定的熱度。而預售屋交易由於具有較低的入門標準,消費者不需要一次拿出高額資金就能購買,而成為現今不動產市場上的主流。然而,卻也存在許多消費爭議,近幾年甚至發生履約保證機制失靈的現象。本文擬以彙整目前常見的預售屋交易問題進行討論,對現行相關監理方式提出建議。
    Most Taiwanese believe that only by owning a house of their own can they have a sense of belonging. At the same time, "buying a house" is also an investment target for most people, and it is one of the options to preserve value and resist inflation. Even though housing prices have continued to soar in recent years, the number of home purchase transactions is still quite large, especially pre-sale housing transactions. Consumers don’t need to spend a lot of money at the beginning to make a purchase. Therefore, it has become the mainstream in the real estate market today. However, there are also many consumer disputes. This article intends to discuss common issues in Taiwan’s pre-sale housing transactions and analyze the supervisory methods used by the competent authorities to deal with these issues. Then refer to foreign laws to find better practices. Make some suggestions on these issues.
