    摘要: 隨著臺灣人口老化問題日益嚴重,長照產業逐漸成為社會重要的議題之一;而政府所推出之長照 2.0 政策,其中的銀髮族長照醫療就醫之交通安排與接駁等,便當有了莫大需求!長照專車連接了銀髮長輩居家到醫療機構之間的交通,而長照司機們更是在長照服務過程中,扮演著舉足輕重的關鍵角色;其提供的安全舒適的交通服務,是確保長者安全、健康及生活品質的重要環節。然而,在聘用長照司機時,僱用關係與承攬關係是需要格外注意的問題。長照司機的僱用關係一般會採用勞動契約方式,以確保勞工權益,亦可以避免因為勞資爭議而造成不必要的糾紛。在承攬長照司機時,應留意其承攬方的合法性、專業素質及工作條件等問題,並確保其與長照服務機構的合同內容符合相關法律法規的要求,以避免因合同糾紛造成的損失。因此,本研究從不同的角度進行探討與比較,首先,本研究針對專家運用深度訪談法進行訪談,同時對於長照司機們進行焦點團體訪談法,藉由蒐集產、官、學及第一線員工的意見與需求,進而比較僱用與承攬關係之差異,並深入瞭解與探討其優缺點。本文之研究目的在於試圖建構一個合理的長照交通模型,透過建構合乎勞動法規,保障勞動權益的經營模式,讓長照 2.0 的交通服務能夠成為一個具備可持續性的安全運作模式。相關研究結果旨在說明僱用關係的勞動型態優於承攬關係,並有助於提供政府主管機關、長照交通業者及服務提供者之管理參考與未來發展方向。
    Abstract
    As Taiwan’s aging population issue becomes increasingly severe, the long-term care industry
    is gradually becoming one of the crucial social concerns. The government’s Long-Term Care 2.0
    policy, particularly the transportation arrangements and connections for elderly long-term care and
    medical services, has seen a significant demand. Long-term care special vehicles provide transportation for elderly individuals to medical facilities, connecting their homes to healthcare institutions.
    Moreover, long-term care drivers play a pivotal role in the long-term care service process. The safe
    and comfortable transportation services they offer are a crucial component in ensuring the safety,
    health, and quality of life for the elderly. However, when hiring long-term care drivers, both the
    employment relationship and contractual arrangement are issues that require special attention. The
    employment relationship for long-term care drivers is generally established through labor contracts
    to ensure workers’ rights and avoid unnecessary labor disputes. When contracting long-term care
    drivers, attention should be paid to the legitimacy, professionalism, and working conditions of the
    contracting party. It is essential to ensure that their contract with the long-term care service institution
    complies with relevant legal requirements to prevent losses resulting from contractual disputes.
    Therefore, this study will explore and compare from different perspectives. First, the study conducted interviews with experts using in-depth interviews. Simultaneously, the study employed focus
    group interviews with long-term care drivers. By collecting opinions and needs from various stakeholders, including professionals, government representatives, academics, and frontline workers, the
    study aims to compare the differences between the employment and contractual relationships and
    gain a deeper understanding of their advantages and disadvantages. The results of this study will be

    valuable in providing management references and future direction for government authorities, longterm care transportation providers, and service providers.
