Abstract:	本文以身心障礙者保障權益為研究範圍，依憲法第7條、15條、第155條基本權保障及憲法增修條文第10條第7項身心障礙者之特別保障，說明憲法對身心障礙者基本權利保障，再將《身心障礙者權利公約》提升至身心障礙者基本權利之保障，試圖以《身心障礙者權利公約》所揭示對身心障礙者保障具體權利之精神與內容，檢視我國《身心障礙者權益保障法》在保健醫療、教育權益、就業權益、支持服務、經濟安全及保護服務等六大面向之落實性及立法缺失，並以國內外案例分析，最後依研究發現，試圖提出立法建言，使我國身心障礙者權益保障更臻完備，期對更能符合我國實際現況，同時與國際同步接軌。
