    Abstract: 「危機就是轉機」,這句話應用於2008年之金融海嘯尤為貼切。全球化之影響下,失業率快速攀升,促使人們開始利用手上之閒置資源為自身增加收入,加上社會與科技之驅使下,使共享經濟商業模式得以於金融海嘯後誕生並快速崛起。共享經濟強調使用權之利用,是以共享平台之方式作為發展媒介,其目的為利用去中心化之方式將雙方交易成本降低,並使人們之閒置資源將其分配至效用最大化。惟因過於前衛之商業模式,於各國之業務拓展中,常因現有法規之限制、共享財貨之外部負效應、影響傳統產業等因素,而被處處限制其發展。

    Airbnb為全球前幾大之短期房屋出租平台,於進駐至台灣後,除了影響我國合法短期住宿業巨甚,甚至影響其他產業之發展。目前Airbnb平台上有許多違法之房源,而我國主管機關針對是否日後將其輔導至合法化,對此皆採取消極之處理方式。認為若使Airbnb合法化有讓日租套房解套之可能,因此需採取對Airbnb加重處罰之方式來遏止其發展。

    共享經濟概念下,探討Airbnb於我國適法性之判斷依據,可從各國對共享經濟之態度及對Airbnb之管制方式來進行對我國管制方式之反思。Airbnb於我國目前有關法律上之困境有消費者保護法、發展觀光條例、定型化契約等問題。另外,亦可從法律經濟分析之角度,來論社會成本及Airbnb營運本質上之問題,本文認為Airbnb若要合法化,需強化Airbnb平台之責任能力,且政府同時需給予法規上之放寬 ,才有可能合法。
    The phrase "crisis is an opportunity" is particularly apt when applied to the financial tsunami that occurred in 2008. Under the influence of globalization, the unemployment rate rose rapidly, prompting people to use their idle resources to increase their income. The sharing economy emphasizes the use of access rights and uses the sharing platform as the development medium. The purpose of the sharing economy is to reduce the transaction costs of both parties by decentralization and to allocate people's idle resources to maximize their utility. However, because of its avant-garde business model, it is often restricted in its development in various countries due to the restrictions of existing regulations, the negative external effects of sharing property, and the impact on traditional industries.

    Airbnb is one of the top-ranked short-term housing rental platforms in the world. After entering Taiwan, it influenced the development of the original short-term housing rental operators and other industries. Currently, there are many illegal room sources on the Airbnb platform, and Taiwan's government takes a negative attitude toward legalizing unlawful resources. For this reason, it is necessary to impose heavier penalties on Airbnb to curb break-law renting.

    To discuss the judgment basis of Airbnb's legality in Taiwan based on the concept of sharing economy, we can reflect a priority on the attitudes of other countries to sharing economy and the way of controlling Airbnb. The current legal dilemmas of Airbnb in Taiwan include Consumer Protection Act, Act for the Development of Tourism, and stereotyped contracts. In addition, we can also discuss the social costs and the nature of Airbnb's operation from the perspective of legal and economic analysis. In this paper, we believe that if Airbnb is to be legalized, the responsibility of the Airbnb platform must be strengthened, and the government must also provide legal relaxation in order to make it legal.
