摘要:	文研究背景，因以往官兵遭懲罰大多都能平反，其原因係相關法條引述錯誤等，故本文重點以「建議陸海空軍懲罰法修定」為本案重點。研究方法採文獻分析法、案件分析法（國防部訴願審議會）及法令分析法（美、德、英、日、中國與我國）。研究目的提供輔導長與監察官在執行懲處審查與軍人涉有違失行為能有明確參考依據。初步研究成果：研究發現陸海空軍懲罰法第24條第1項前段，檢束「自我反省」概念較模糊，建議於例假、休假或放假日實施親筆450至500字自我檢討報告，達自我反省目的；另陸海空軍懲罰法第25條第1項前段，禁足「必要教育」概念較模糊，建議休假或放假日實施軍記教育教育光碟收視8小時，達必要教育施目的。 The background of this paper is that most of the punishments meted out to officers and soldiers in the past have been rehabilitated due to the misquotation of relevant laws and regulations, so the focus of this paper is on the "proposed amendments to the Army, Navy and Air Force Punishment Law". The research method used is documentary analysis, case analysis (Ministry of Defence Petition Review Committee) and legal analysis (US, Germany, UK, Japan, China and China). The aim of the study is to provide a clear reference for counselors and supervisors in the execution of disciplinary examinations and military personnel involved in misconduct. Preliminary findings: The study found that the concept of "self-reflection" in the first paragraph of Article 24, Item 1 of the Army, Navy and Air Force Punishment Act is rather vague. It is recommended that a self-examination report of 450 to 500 words be written during regular leave, holiday or holiday to achieve the purpose of self-reflection; and the concept of "necessary education" in the first paragraph of Article 25, Item 1 of the Army, Navy and Air Force Punishment Act is rather vague. The 8 hours of viewing should be used to achieve the purpose of necessary education.
