摘要: | 隨著金融科技(FinTech)之發展日新月異,為鼓勵金融科技發展,提供消費者更加便利、多元化之金融服務,並同時保護現有之金融體系,英國金融行為監理總署(Financial Conduct Authority, FCA)於2014年提出「金融監理沙盒(Financial Regulatory Sandbox)」實驗機制,而新加坡、澳洲、香港亦隨後跟進推行金融監理沙盒制度。此等四個先行國家均實行相當順利,每年申請進入沙盒實驗之案件有百件以上,且有相對較高之通過率。
我國《金融科技發展與創新實驗條例》於2018年4月30日正式施行,成為全球第一個將金融監理沙盒成立專法之國家。惟我國之金融監理沙盒施行三年多以來,實驗申請件數及核准件數逐年減少,而通過實驗並確定已開始發行之金融商品更是屈指可數。是以,我國沙盒制度是否真能發揮其應有之功能與目的,有待商確。
本文提出以下三點作為本篇論文撰擬之核心:一、探討金融監理沙盒制度之目的。二、分析我國及其他先行國家施行金融監理沙盒制度之運作成果與經驗。三、藉由分析其他先行國家推行金融監理沙盒制度之成果與經驗,觀察我國制度目前現況,分別就申請階段、評估階段、實驗階段及落地機制等階段,提出實務運作之問題,並檢視是否尚有可借鑑他國以完善制度之處。
最後,本文贊同我國為促進金融創新發展而引進金融監理沙盒制度。為實化金融監理沙盒制度於我國之運作,提供更完善之金融科技發展環境,本文嘗試提出對於現行制度之若干建議,期能供日後調整或修法之參考。
As FinTech has rapidly advanced, to encourage the continuous innovation in financial technology, to provide consumers with convenient diversified financial services, and to protect the existing financial system, the Financial Conduct Authority of the U.K. proposed "Financial Regulatory Sandbox" in 2014. The "Financial Regulatory Sandbox" system has been well prevailing in the U.K., Singapore, Australia, and Hong Kong. There are more than 100 applications for entering into the sandbox experiment each year, and the passing rate is relatively high.
The first country to enact the "Financial Regulatory Sandbox" into codification is Taiwan where the “Financial Technology Development and Innovative Experimentation Act” was promulgated as officially implemented on April 30, 2018. However, the number of applications and approvals have been decreasing year by year since the effectuation of "Financial Regulatory Sandbox". It is doubtful that the "Financial Regulatory Sandbox" is able to exert its function and purpose.
The following three (3) points are the core issues of the thesis: 1. The purpose of the "Financial Regulatory Sandbox " 2. Analyze the operating results and experience of Taiwan and other leading countries in implementing the "Financial Regulatory Sandbox" system. 3. By learning from previous experiences in the U.K., Singapore, Australia, and Hong Kong and shed their lights onto us, this thesis identifies the questions raised by Taiwan’s current practice, and seeks to provide recommendations in regards to regulatory sandbox in Taiwan.
This thesis agrees with the authorities formulated the "Financial Regulatory Sandbox" to promote financial innovation and development. To prevail the "Financial Regulatory Sandbox" system and provide a friendly environment to develop financial technology, the thesis attempts to propose some suggestions for the current system, which can be used as a reference for amendments in the future. |
