    摘要: 原住民多數族群有自己的生活方式、並形成自身獨特的文化。我國憲法明確的保障原住民族的文化權利,而狩獵自古以來的生活方式當然包含在文化權利的範圍內,並且由憲法賦予權力制定的原住民也表明原住民有狩獵野生動物的權力。
    本文就原住民狩獵與野生動物保育法及槍砲彈藥刀械管制條例的爭議問題來探討,了解原住民狩獵傳統文化有所相關之規範是否足認已落實,能體現我國對多元文化之重視。惟,雖然野生動物保育法和槍砲彈藥刀械管制條例已有相關規定,但文化認知度的不足以及規範的不足之處,以致判決結果往往與原住民的期待相違。
    最後,本文將以訪談分析方式呈現,原住民對於狩獵文化與野生動物保育法及槍砲彈藥刀械管制條例的看法,如原住民在狩獵文化與野生動物保育之間將做何種選擇、對於獵槍的規範希望能開放什麼限制,或是現行之規定是否與原住民的狩獵文化相輔相成。是以,以原住民對於狩獵文化及野生動物保育法、槍砲彈藥刀械管制條例為架構,提出初步的建議,希冀司法實務在面臨與原住民相關刑事案件時,將原住民文化帶入具體個案中進行闡述,從不同視角出發觀察原住民族文化後,能在
    考慮動物權益等問題的同時,亦保障原住民族的文化權利,而能受惠更多原住民族人。
    Most of the aborigines have their own way of life and form their own unique culture. my country’s constitution clearly guarantees the cultural rights of indigenous peoples, and the way of life of hunting since ancient times is certainly included in the scope of cultural rights, and the indigenous peoples entrusted by the constitution also show that the indigenous people have the right to hunt wild animals.
    This article discusses the controversial issues of the Aboriginal Hunting and Wildlife Conservation Law and the Regulations on Guns, Ammunition, Knives, and Arms, and whether the relevant regulations of the Aboriginal hunting traditional culture are fully recognized and implemented can reflect my country’s emphasis on multiculturalism. However, although the Wildlife Conservation Law and the Firearms, Ammunition and Knives Control Regulations have related regulations, the lack of cultural awareness and the inadequacies of the norms often result in the verdicts that often contradict the expectations of the indigenous people.
    Finally, this article will present in the form of interview analysis, the indigenous people’s views on hunting culture and wildlife conservation laws, guns, ammunition, and weapons control regulations, such as what choices the indigenous people will make between hunting culture and wildlife conservation, What restrictions do the hunting gun regulations hope to open up, or whether the current regulations are complementary to the hunting culture of the aborigines. Therefore, based on the aboriginal people’s hunting culture and wildlife conservation law, guns, ammunition, and weapons control regulations, preliminary suggestions are made, hoping that judicial practice will bring aboriginal culture into the concrete when facing criminal cases related to the aboriginal people. The case illustrates that after observing the culture of the indigenous peoples from different perspectives, while considering issues such as animal rights, they can also protect the cultural rights of the indigenous peoples and benefit more indigenous people.
