| 摘要: | 我們在使用社群網路、通訊軟體以及收看傳統媒體報章雜誌時，面對大量流通的資訊時，是否曾經懷疑自己所接收到的資訊是正確的? 如今無論是社群網路或各大媒體，皆有可能出現不實資訊流通傳遞的可能，甚至有時候發現該資訊乃不實資訊之時為時已晚，不實資訊所造成的傷害已經產生，此時的所作所為都是亡羊補牢。
如今網路的資訊傳遞與流通發展已脫離不了社群網路，在我們透過社群網站接收資訊時，除了自身對資訊真偽之過濾以外，社群網站其實早已發展出一套針對不實資訊進行過濾及篩選的自動偵測機制，藉此維護社群網路之使用環境；但隨著時間的發展，社群網路之使用者亦發現，除了有大家認知的負面內容之外，社群網路亦會刪除部分經營方認定不應該分享至社群網路之內容，但這類的內容並非是社會大眾所不能接受之資訊，或這些內容只是普通的意見及言論發表。社群網路經營方這類刪除或限制發文者發文內容之行為，除被質疑對社群網路內容管控不當，更招致社群網路侵害使用者言論自由之批評。
本研究首先介紹不實訊息之成因、散布途徑，再介紹不實訊息之內容、形式、傳播媒介等，以及不實訊息對網路及現實社會之影響。再以我國法律之觀點介紹我國處理不資訊之法源，以及藉由實務裁判來分析我國司法實務如何處理不實訊息氾濫之問題，並簡單整理外國對於不實訊息氾濫問題在法律面之處理方式。隨後整理出在言論自由之框架下處理不實資訊時所要面對的問題，以及處理不實訊息在言論自由方面所遇到窒礙難行之問題。再來是介紹除了法律面以外處理不實資訊之方式，包括政府、社群網站以及第三方事實查核之運作方式，以及這三者在實際運作時所面臨的困境，最後再作出本研究之結論。
When we use social network, connecting messenger and read traditional media. To face tremendous information, we may doubt the information we get is truth or false. No matter media or social network, we may get disinformation on these websites, even though we found the information is wrong, but that is too late, the damage made from disinformation is happening.
From now on, the development of information and connection can’t get away from social media. Not only we find disinformation by ourself, but also the algorithm developed by social network to detect disinformation is working every time to maintain social network environment. Social network’s users found that not only t negative information recognized by the public, but also simple information shared from users still have risk from deleted by the algorithm’s detect. But those information is not rejected from public or just a simple speech or comment. Social media were accused for reasons by passive information management and delete or restrict users to make twit, those behaviors get critic for injured the liberty of speech.
First, this research introduce the reason why disinformation happened, speared route, and then introduce the content, format and broadcast media of disinformation and influenced to social network and reality society. Then introduce the law resource by domestic judicial view point and research the solution to solve disinformation by domestic judicial review and make research how foreign countries to solve the disinformation problem by law. Then find out the problem by the restrict liberty of speech to solve disinformation. Then introduce solutions for disinformation despite law, e.g. government, social network and FactCheck, how they work, their relationship and problem they have to face. Then make the final conclusion. |
