| 摘要: | 自1840年起，毒品便影響著近代亞洲的歷史發展，至今已然成為國際議題。隨著毒品戰爭所獲有限下，國際社會的防制態度也有所轉向，甚至出現合法化聲浪，如此價值觀的衝擊，如此不禁令人好奇，究竟為何針對毒品進行防制？
對此本文首先透過歷史回顧方式，完整還原鴉片對東方國家所造成的影響，藉此探索出毒品蘊藏的龐大利潤，本於「控制並減縮毒品市場」的防制目的，從利潤角度進行深入探討，從對合關係針對我國現行制度進行總體檢，尤其針對需求面（施用）情況進行探討，並認為其係屬整體毒品市場下的被害人，而主張將施用行為予以除罪，以此強調其被害人地位與醫療協助重要性。最後，在施用毒品行為的除罪理念下，除對現行施用處遇上進行改善外，同時在施用個案完成戒癮療程後，提出有關協助個案復歸社會的後續配套。
然而，在對合關係的架構下，防制的設計自不能單就施用處遇進行改善，尚須思考如何改善如今毒品氾濫的外在環境，尤其現今新興影響精神物質（New Psychoactive Substance，簡稱NPS）猶如雨後春筍般地出現，更加突顯其重要性，然此尚非論文現時主題所能提及，但本文對此亦有初步建構，以供後續研究意見。
