摘要: | 憲法保障之言論自由於著作權中之戲謔仿作是否為合理使用?近年來因網路世界發達,重製之戲謔仿作造成之爭議逐漸過大,本文將從伯恩公約、歐盟各國、美國,再到台灣對於著作權中合理使用之比較。討論我國著作權法第六十五條承襲美國著作權第一百零七條之四項檢驗標準,又以 1994 年美國經典案例衍生出「接觸」與「實質近似」判斷標準,至今所帶來之影響,參考歐盟各國新修法之趨勢及結果,最後再以 2017 年周湯豪&黃乙真一案為例,討論作品之轉化性利用、對市場潛在之影響以及著作權法中檢驗標準檢視完有何缺失,是本文所討論之方向。
Is the ridiculous parody of the freedom of speech guaranteed by the constitution in copyright a fair use? In recent years, due to the development of the Internet world, the controversy caused by the mockery of remake has gradually become too big. This article will compare the fair use of copyright in the Berne Convention, EU countries, the United States, and then to Taiwan. Discuss the impact of Article 65 of my country’s Copyright Law that inherits the four test standards of Article 107 of the United States Copyright, and derives the "contact" and "substantial similarity" criteria based on the classic case of 1994 in the United States, and the impact it has brought so far Finally, taking the case of Zhou Tanghao & Huang Yizhen in 2017 as an example, discussing the transformative use of works, the potential impact on the market, and the lack of inspection standards in the copyright law are the directions discussed in this article. |
