    摘要: 隨著科技發展,著作的外觀以及交易模式產生了相當大的變化,如音樂、書籍、電影或者電玩遊戲等,不再僅有實體形式呈現於大眾面前。許多著作以「數位版」的樣態,於網路平台進行交易,消費者付費後即可透過網路下載並安裝至其電子載體。而過往消費者購得實體著作後,得主張著作權人之權利已耗盡,就其所購得之著作物自由轉售、出借等處分,即著作權法之「散布權耗盡原則」之體現;然而,數位版著作是否亦得自由處分?
    現況下之交易模式中,著作權人透過契約以及科技保護措施,限制了消費者對其購得之數位著作物的自由處分之權利。其中,著作權人即主張數位著作之消費者係被授權者(又稱之為使用人)而非所有權人,且數位著作之使用人將數位著作轉讓之行為涉及著作非法重製問題,將不符合散布權耗盡原則中著作必須「合法」之限制。種種因素,使得數位著作之消費者,不得基於散布權耗盡原則而將其所購得之數位著作為轉售、出借等處分。
    因此,本文重新檢視著作權法之保護目的、基本原則等,並進一步思考散布權耗盡原則之核心以及實體著作與數位著作之異同;此外,亦參考了美國及歐盟之相關判決,試圖釐清數位著作於散布權耗盡原則適用上之爭議點為何。最後,回到我國著作權法之規定,檢視我國現行法規在面對數位著作轉售時可能涉及之相關條文與涉及之問題進行梳理。
    最後,本文彙整相關爭議及意見,並以報酬衡平作為思考基礎,對數位著作之散布權耗盡適用提出可能之解決方向,並對我國現行法規範之修正提出個人意見。

    With the development of science and technology, the appearance and transaction mode of works have undergone considerable changes, such as music, books, movies or video games, etc., and are no longer only presented in physical form to the public. Many works are traded on online platforms in the form of "digital version", and consumers can download and install them on their electronic carriers through the Internet after paying for them. In the past, after consumers purchased physical works, they could claim that the distribution right of copyright proprietor had been exhausted, and they could freely resell or lend the purchased works. , Are digital works also free to dispose of ?
    In the current transaction mode, the copyright proprietor restricts the consumer's right to freely dispose of the digital works purchased from the copyright proprietor through contracts and technological protection measures. Among them, the copyright proprietor maintains that the consumer of the digital work is the licensee (also known as the user) rather than the owner, and that the user of the digital work transfers the digital work involves the illegal reproduction of the work. The work must be "legal" , then the owner can claim the copyright proprietor's rights had been exhausted. Due to various factors, consumers of digital works can't based on copyright exhaustion doctrine to resell, lend the digital works they have purchased.
    Therefore, this article re-examines the protection purpose and basic principles of copyright law, and further considers the core of copyright exhaustion doctrine. Then , this article tries to figure out the similarities and differences between physical works and digital works.What is the point of contention over the application of the copyright exhaustion doctrine? Finally, back to the provisions of Taiwan's Copyright Law, this article will review the relevant provisions and issues that may be involved in the current laws and regulations in Taiwan when dealing with the resale of digital works.
    Finally, this article summarizes relevant disputes and opinions, and takes the balance of remuneration as the basis for thinking, proposes possible solutions to the application of the exhaustion doctrine in digital works, and puts forward personal opinions on the revision of the current laws and regulations in Taiwan.
