Abstract:	勞動基準法第84條之1原為社會經濟變動，勞動條件也隨之變更，在1996年為擴大勞基法適用對的範圍而新增，但自本法新增適用後，問題慢慢浮出，勞資雙方的爭議也屢見不鮮。例如華航空服員罷工及保全人員等長期超時工作，所引發諸多疑慮與爭執，究其原因，源於目前我國實務操作下「責任制」有被資方擴大或濫用其制度，而處於弱勢的勞方在欠缺資源與成熟的集體力量很難與企業主對抗。上述的華航罷工與保全業長期超時工作的事件，只是冰山一角，愈來愈多因超時工作導致職災傷亡或過勞的現象層出不窮，工程師與醫師常有過勞猝死的情況，但新聞都很快帶過，沒有人真正關切背後的原因，直至2017年2月13日蝶戀花國道五號遊覽車翻覆事件，因為一個人的工作導向單純的交通意外，但因為死亡人數太多，終於為社會所重視工時過長可能發生無法彌補的遺憾。有鑒於此，本文認以對勞基法第84條之1的設立，應該適時隨時代變化而更新，在文的最後個人提出本對法規的可行的配套措施，希望能有助於法規適用的完整。 Article 84-1 of the Labor Standards Act was originally a social and economic change, and labor conditions changed accordingly. The reason is that the "responsibility system" under the current practice in my country has been expanded or abused by the management, and the weak It is difficult for labor to confront business owners in the absence of resources and mature collective strength. The above-mentioned incidents of China Airlines strike and long-term overtime work in the security industry are just the tip of the iceberg. There are more and more occupational accidents, casualties or overwork caused by overtime work. Engineers and doctors often die of overwork, but news They were all taken quickly, and no one really cared about the reason behind it, until February 13, 2017 Dielianhua National Road No. 5 tourist bus overturned, because one person's work led to a simple traffic accident, but because of too many deaths, finally Long working hours, which are valued by society, may cause irreparable regrets. In view of this, this article believes that the establishment of Article 84-1 of the Labor Standards Law should be updated in time with the changes of the times. At the end of the article, I propose feasible supporting measures for the regulations, hoping to help the application of the regulations. whole.
