    摘要: 有鑑於公寓大廈區分所有建築物的土地持分分配態樣甚多,而區分所有建築物對於該建築基地持分應分配多少,並未有強制性的規定。我國於民國84年6月制定公寓大廈管理條例後,又於民國98年民法修訂物權篇相關條文(799、800條亦同時修訂),同時增訂799-1、799-2條予以規範區分所有權人之權利義務關係,歷經立法及修法,時至今日也只是一原則性規定,係按專有部分樓地板面積之比例分配,但實務上也有挪出一部分面積比例給公共設施停車位分配,其餘按專有部分樓地板面積之比例分配,針對現行公寓大廈區分所有建築物土地持分的分配於法規上與使用上是否符合公平與合理進行研究。
    為瞭解公寓大廈區分所有建築物的土地持分分配及使用管理,於產權分配的規劃及使用管理的發展,所面臨的困境與法規的衝突,本研究以新北市板橋區新建住宅大樓為例,先就公寓大廈區分所有建築物的土地持分分配及使用管理,於法規上之公平性與合理性進行調查分析及法規上與現實上的落差,再以其調查所得之實際情形,進行產、官、學界訪談,藉以分析公寓大廈區分所有建築物的土地持分分配及使用管理的現況與障礙,最後透過訪談結果的整理,提結論與建議。
    In view of the fact that there are many types of land holdings of buildings for condominium complex to all partition buildings, there is no mandatory provision to distinguish how much all buildings should be allocated to the building base. Since Taiwan enacted the Condominium Administration Act in June 1995, and then amended the relevant provisions of the chapter Rights in Rem of Civil Code in 2009 (Article 799 and 800 were also amended at the same time), and added Article 799-1 and 799-2 to regulate the relationship of all partition owners between rights and obligations has been passed through legislation and amendments. Up to today, it is only a principled rule, and it is allocated according to the proportion of the floor area of the exclusive part of the floor. However, in practice, a proportion of the area is allocated to the parking spaces of public facilities. In terms of regulations and use, the research conducts on the allocation of land holdings of all buildings in the current condominium complex whether is fair and reasonable or not.
    To understand the distribution of land holdings of buildings and the use management of the partition building of the condominium complex, due to the development of property rights planning and the use management, the dilemma has been faced and the conflict for regulations. In this study, taking the new residential building in Banqiao District, New Taipei City as an example, the allocation of land holdings and the use management of all partition buildings in the condominium complex are first. With the fairness and rationality in regulations, it investigates and analyzes the difference between laws and reality, and then it based on the actual situation obtained from the investigation to conduct interviews among industry, government and academia, and to analyze the current status and obstacles of the distribution of land holdings and the use management of partition building. Finally, it has been through the collation of the interview results, conclusions and suggestions.
