摘要:	由於生育率及死亡率的降低，導致人口老化的問題。因此，近年來，與年長者相關議題備受重視，而成年監護制度即為當代重要課題之一。本文先檢視我國成年法定監護制度之現況，再輔以日本之成年法定監護制度作為對比，並從而檢討我國現行法有何不足之處；再觀察我國之成年意定監護制度，並比較其與日本之成年意定監護制度有何不同之處，進而檢討我國法之不完善之處。　　我國之成年監護制度分為成年法定監護及成年意定監護兩種，雖成年法定監護制度已存在甚久，但仍有不完善之處，例如監督機制過於被動等；而成年意定監護制度，係於2019年始公布施行，亦有其不足之處，例如未明文不得委任代理之事項、無監護監督人之設計。因此本文透過比較研究之方式，將我國與日本之成年監護制度相比較後，參考其優點，並避其缺點，針對我國之不足之處提出建議，期能提供參考，使我國之成年監護制度更加完善。 With the decrease of birth rate and death rate, the problems about aging population grow more and more serious. Recently, concerns about the elder arouse worldwide awareness. Especially, guardianship system for adults has been one of the most significant issue nowadays. The essay starts with viewing the implementation of legal guardianship system of adults and adult guardianship by agreement nowadays first, along with the contrast of those in Japan. According to the difference between Taiwan and Japan, the essay will further reflect on the flaws of related laws implemented in our country and discuss about improvements. 　　In Taiwan, the guardianship system of adults includes legal guardianship system of adults and adult guardianship by agreement. In spite of the long-term existence of legal guardianship system of adults, reform and better improvement are still in necessity. For instance, the supervisory system is far too passive, and so on. In terms of voluntary guardianship system of adults, which has been announced and performed in 2019, is still in desperate need of improvement. The deficiencies of it include the lack of related regulations about commission and plans about supervisor of guardianship, and so on. With above-mentioned problems, the essay adopts the way of comparative research to make comparisons of guardianship system of adults between Taiwan and Japan. Ultimately, retaining the advantages and abandoning the disadvantages of Taiwan and Japan, this essay makes some suggestions for the deficiency of related laws in Taiwan, hoping to provide better plans of improvement and make guardianship system of adults in Taiwan more advanced and complete.
