| 摘要: | 近年來注意到網路上逐漸出現各類新興的網路平台在科技逐漸日新月異的影響下，我國的制度是否能夠因應及保障ISP業者之權利，加上近年來每個人手一隻智慧型手機，其本身便是一種統合形媒介，只需要一隻手機便能講電話、上網、購物、觀看直播…等用途，甚至本文之主軸影音及遊戲平台也積極開發出除了固有電腦此一媒介拓展出新的界域。因此只有一種的單一式服務已無法滿足使用者之需求，且ISP業者既居關鍵地位，具有管控危險的能力、資源及知識，故為法律政策優先執行之對象，而如今影音及遊戲平台為大多民眾消遣娛樂之核心，但日漸增加之爭議於我國所制定之規範是否合適？如二次創作之內容若為之上傳其判斷之依據在我國與他國間之差異為何?又直播之方面在現代擁有何種屬性?本文先由介紹我國目前所分類之ISP業者和新興ISP業者開始介紹，再來介紹目前我國面前之免責規定，與美國和中國間之比較，最後介紹目前所有之爭議以及最後之建議及結論。
