    Abstract: 高度仰賴資訊系統的智慧農業,面臨與其他資訊系統一樣的安全問題,政府及巨農企業建置的農業資訊系統,應事前充分做好與農民的溝通協調,避免侵犯開放農地的個人隱私權。至於要求農民上傳的農業資訊,如涉及經年累月的知識經驗等營業秘密或訣竅,原則上該等資訊有權應歸屬於農民,資訊蒐集者亦得與農民約定所有權甚至更重要的使用權內容、範圍、時間與地區。農業資訊利用過程中若遭遇小農與巨農權益不平衡對待時,國家公權力應事實適度介入管制,如公權力效能不彰,再考量公民參與及公私協力調整政府、巨農企業及小農等各自追求的個人權益與公共利益。
    The smart agriculture that relies heavily on the communication system is facing the same security problems as other communication systems. The agricultural information systems established by the government and giant agricultural enterprises should fully communicate and coordinate with farmers beforehand to avoid infringement of privacy and any property right. As for information collectors that require farmers to upload or transfer agricultural information to any third parties, such information should be treated as business secrets involving years of knowledge and experience. The rights and interests of such information shall be attributed to farmers, and information collectors must also reach an agreement with farmers regarding ownership. In the process of agricultural information utilization, if the rights of small farmers and giant farmers are treated in an unbalanced manner, the state public power should appropriately intervene in the regulation. However, when the public authority's intervention is inefficient, citizens should consider partnering up with the government for the best results and find the balance between the public and private interests of agricultural enterprises, small farmers and public officers.
