    摘要: 師者,所以傳道、授業解惑也,教師是學校教育的基石,唯有專業優良之教師方能培育出優秀之下一代學子,中華民國憲法第158條至第167條教育文化篇規定國家對教育文化之方針,再者中華民國憲法增修條文第10條第10項更直接說明了,苦不能苦孩子,窮不能窮教育之基本國策,然而落實教育之國家根本大業的重責,則落在每一位教師所的肩膀上,故如因為教師個人行為、精神或情緒因素致有教學不力或行為不檢等偏差情形,其不僅影響學生受教權益,更嚴重損害教師的專業形象與聲譽。
    以往大法官解釋,甚少著墨於老師解聘此一領域,然在101年7月27日大法官會議公佈了第702號解釋,其針對教師解聘事件做一明確性之闡明,本號解釋不僅影響教師個人基本權利甚鉅,也促成了日後教師法修法,本文現就以此號解釋為基礎以102年修法前之教師法第14條第1項行為不檢有損師道,經有關機關查證屬實為例,探討現今公立高級中等以下學校教師之(一)任用法律性質、(二)救濟制度,(三)教師評審委員會之組成、(四)教評委員會就解釋事件之審查密度(五)教師法修法檢討等做一結構性之解析,誠以基於上述之研究,希望能與各位先進後學分享,對日後人事業務上有實質之助益。
    A teacher is one who transmits knowledge, provides for study,and dispels confusion.A teacher is vital to education of school, and only professionally outstanding teachers can afford it from generation to generation.From Article 158 to Article 167 of the Constitution of the Republic of China establishes the aim of national education and culture.Furthermore, the Additional Article 10 of the Constitution of the Republic of China immediately interprets the “priority to education” of the Fundamental National Policies.But the fulfilment of the obligation to carry out the national education policies is imposed on every teacher’s shoulders.
    So, as above-mentioned, if teacher’s incompetence and misconduct result from individual behavior, emtion, mind, it would probably affects not only right to education for students, but also teacher’s impression and reputation.
    Previous Judicial Yuan Constitutional interpretation rarely involved in this domain regarding decision of dismissal of public school teachers, while Constitutional Interpretation No.702 definitely expounds views on the dismissal of teachers on July 27th,2012. This interpretation tremendously influences teacher’s interests and rights, and it also gives an impetus to later amendment for Teachers’ Act. This thesis will explain the Article 14 paragraph1 of the Teachers’ Act before amendment in 2013 -- Misconduct prejudicial to teacher’s dignity and manifestly verified by authorities concerned, based on the interpretation No. 702 to discuss the below-mentioned issues in reference to current teachers at the public senior high school and lower
    (1) The nature of law for teacher’s- appointment
    (2)Procedures of administrative remedies for teachers
    (3)The organization of teacher evaluation committee
    (4)Intensity of review for teacher evaluation committee
    (5)Analysis and review on the amendment of Teachers’Act
