摘要: | 根據我國憲法第10條規定,人民有居住及遷徙之自由,因此,居住權可視為人民的基本權利。1989年發生在台灣的無殼蝸牛街頭運動,喚起台灣社會正視居住正義;馬英九(2011)在「黃金十年」的國家願景中指出,落實「居住正義」乃公義社會的施政主軸。包租包管即是由政府、專責機構或委託民間業者承租民間住宅;代租代管則是由業者協助房東出租住宅予政府所規定一定資格之房客,並由政府補助服務費用,以代理房東經營管理出租住宅,政府預期可讓企業與屋主及住民三方都獲得利益,亦能藉此創造出落實居住正義的契機。
本研究欲從實務的細節中探討理論意涵與實質執行意義, 因此選擇質性研究, 以次級資料及相關文獻的分析為基礎來做本文探討之依據, 以蒐集主管機關公開揭示之公報資料與台北市實際從事包租代管業務之社會企業業者在行動上涉及社會公益、 解決社會問題意涵之事項成果作為為研究範圍。 以探索包租代管業是否能成為社會企業發展的經營新面向, 並冀望從而擴展為政府在推動居住正義或社會企業的發展與經營策略研究時之參考。
本研究初探出包租代管呈現在實踐居住正義上的作為與共同性上,除建議可以香港作為借鏡,其特質亦是未來的趨勢,可讓未來欲建構具台灣在地性之社會企業者,作為規劃發展的考量及發想上的新選項。
According to the Article 10 of Constitution of People's Republic of China, the people has the free to live and migrate. Therefore, the right of abode can be regarded as the fundamental rights of the people. In 1989, the Shell-less-snail social movement evoked the society to face the right of abode in Taiwan. In 2011, President Ying-Jeou Ma pointed out the "Golden Decade" in the national vision, implementing the right of abode is the main administration to the social justice. The charter escrow is renting a private residence by the government, the specialized agencies, or the entrusted private traders, then the rental escrow is the landlords, who were given assistance by the traders, renting a home to the tenants who is qualified in government's regulations. And the government subsidizes the service fee to act as agent the landlords manage the rented residence. Renting a home, the government is expected to benefit both the businesses and the homeowners and the residents. It can also create an opportunity to implement the right of abode.
This study wants to investigate the meaning of theory and substantive execution from the details of practice. Therefore, we chose qualitative research, based on the analysis of secondary data and related literature by collecting the bulletin information and the social enterprise actually engaged in charter escrow in Taipei, which actions involve social welfare and solving the problems of social issues as the scope of research. In order to investigate whether charter escrow can become the new managing orientation of the development of social enterprises. And, it is looking forward to expand to the government's reference to promote the right of abode and the development of social enterprises, and the research of business strategy.
This study investigates the act and commonality of charter escrow in the right of abode of the practice. In addition to the suggestion that taking example by Hong Kong, and its characteristic is also the future trend, which will let the future to build a social enterprise with Taiwan's locality as a consideration for development of planning and a new options on the idea. |
