    Abstract: 本研究分為六章,首章為緒論,明述本論文之研究動機與目的,並界定研究方法與範圍。第二章係討論一般與特殊侵權責任之種類、成立要件,以及舉證責任分配一般原則與減輕體系建構。第三章則闡述商品責任與公害責任之性質與範圍,並比較兩者在實體法方面之異同。
    第四章與第五章分別以消費者保護法第7條與民法第191條之3為例,解析商品責任與公害責任之成立與舉證責任分配;並對舉證責任之妥當性分配問題,分別以因果關係、可歸責性與損害賠償額確定為核心探討。
    第六章則根據前述研究過程,提出適當結論與合理性建議。

    The current study is divided into six chapters. Chapter one describes the motives and purposes of the research and defines the method and scope it involves as well. Chapter two explores the kinds and elements of the general and individual tort law, allocation of burden of proof and lessening the burden of proof. Chapter three elaborates on the nature and scope of Product Liability and Public Nuisance Liability, with their differences in Substantive Law being contrasted.
    Chapters four and five respectively adopt examples from the Article 7 of the Consumer Protection Act and Article 191-3 of the Civil Law for discussion on Product Liability and Public Nuisance Liability elements and allocation of burden of proof. These two chapters treat perspectives pertaining to causation、imputativeness and assessment of damages in equitable allocation of burden of proof as the core issues to be investigated.
    Chapter six concludes this study and proposes suggestions of feasibility based on the procedures mentioned previously.
