Abstract:	在審判之程序中，對於系爭事實之認定，若遇有關涉及專業領域知識領域的情況底下，就需要具有專業知識領域之專家提供專業意見幫助法院做出判斷，以協助法院達成發現真實之目的。而對於具有專家身分之人，如何引進訴訟程序中協助法院判斷系爭事實，於台灣之訴訟制度，乃採行大陸法系當中鑑定人制度，以此方法將專家引入訴訟程序之中。但就此制度之實行，對於台灣改採改良式當事人進行主義後，就相關之法條規定，如鑑定人之選任，乃至於法條所未規定之何種事項需要鑑定人介入以釐清事實，乃至於與改型後之訴訟制度有所牴觸，實有討論之空間。另外，就鑑定人在台灣刑事訴訟程序當中，究竟是處於何種地位行使其權力以及其所負擔之義務，在本文中都會做有探討，在確定該等鑑定人在訴訟程序之定位後，再行介紹台灣鑑定人制度，之後再對其缺失部分做探討後，再介紹與台灣鑑定人制度類似之專家證人制度，就其在美國司法制度之規定如何以及其實際運用之狀況，於探討其制度之內容之後，點評出其具有之優勢之處，接著，在於台灣對於是否引進專家證人制度之趨勢也愈來愈高，是以，就引進之趨勢以及建構專家證人制度之架構，提出初步之芻議，以完善台灣對於刑事訴訟法有更完善之可能，並且符合憲法保障人民訴訟權之可能。 In the trial procedure,if the case which involve perfessoinal knowledge,in this time,need someone who possess peressional knowledge to help the court to make judgements.In Taiwan,leading experts into the trial procedure is according to identification system.But this system is contradicted the adversary system in improving type,whether electing appraiser or necessary of Identification.This research try to discussing about that. In addition,this research discuss how the appraiser exercise power and burden obligation in Taiwan criminal procedure. After determining the identity of the appraisers,second,introduce Taiwan appraisers system and discuss the missing part. After introducing the Taiwan Appraisers System,in next step,introduce the expert witness system which similar to the Taiwan expert system. Explore its provisions in the US judicial system and how to use it. After discussing the expert witness system,we will talk about the advantages in the expert witness. At last,in Taiwan,the trend of the introduction of an expert witness system is also growing,therefore,the trend of introduction and the structure of the expert witness system is the point in this research.This research make a suggestion that how to construct an expert witness system to improve criminal litigation system in Taiwan and conforms to the Constitution and guarantees the right of people.
