由於網際網路的快速發展,對於傳統商品及服務等商業行為之交易,產生革命性的變化。與傳統契約相比,電子契約本質上一樣,形式上卻不一樣,所以在網路交易中難免會產生問題,例如電子契約之成立要件是否一致、網站業者與消費者之爭議、標價錯誤、管轄權之處理等問題。網頁上的標價屬於要約引誘亦或是要約為問題所在,學說偏向要約引誘,但實務則沒有一定立場,另外電子代理人、電子簽章之意思表示是否直接等同於當事人,都產生諸多的法律爭議。本文所欲探討的即在網路交易中,以意思表示所產生之問題,進而在導引到網路購物時,消費者點選我同意但忽略業者所載明之定型化條款,跟業者標價錯誤所產生之風險。
Due to the rapid development of the internet ,it has a revolutionary change between the traditional goods and business transaction .Compared with traditional contract ,electronic contract is the same in essence while difference in forms ,it may cause many problems .For example ,the establishment of elements、consumer dispute、false price indication and jurisdiction.The web page information is a contract offer or just an invitation to offer is the most important to discuss ,and the legal validity by automated system created by online stores constitute contract promise .This article focuses on the cyber expression ,describe the consumers ignore the contract of adhesion and the e-commerce with false price.
