    Abstract: 於目前全球人口與氣候變化趨勢而言,確保糧食供給量之足夠實為一刻不容緩之議題,基改作物目前雖仍有爭議之處存在,亦仍有持續開發研究之需求,然因基改作物本身會傳播基改物質之特性,會對周遭環境造成基因污染危險,如何在現行法規架構下確保各責任主體之間之法律關係,即是本研究要探討之課題,本研究將從基改作物與農業現況進行探討,分析與基改作物相關之國際公約內容,包含基改作物權利保護、跨境轉移之風險評估、環境問題三層面,搭配美國、日本以及台灣之立法例進行比較法分析,最後探討基改作物進行商業種植後,基改權人、土地耕作人、土地所有人以及鄰地所有人之間的權利義務關係。
    Food supply is an important matter in climate change and global population trend. Genetic Modified Crops is still be developing, even it has some controversy now. Genetic Modified Crops have opportunity to cause genetic contamination, because it has the nature of transfering genetic material. The subject of the study is how to ensure that the legal relationship between the responsible entities and the existing regulatory framework. The study will explore the status of Genetic Modifed crops and agriculture, and analyse the contents of the international conventions relating to Genetic Modifed crops, including the rights of GMOs, risk assessment of cross-border transfer, and environmental issues. This subject will do comparative law research in U.S., Japan and Taiwan. Finally, I will discuss the rights and obligations between the land reformers, the land cultivators, the landowners and the neighbors.
