    題名: 我國現行地上權住宅課題之研究

    摘要: 選擇購買地上權模式住宅者,通常是看中地上權模式住宅之低價優勢,依其負擔能力選擇符合其需求之住宅,以先取得得以容身之住房。惟地上權模式住宅於我國運行之下,面臨種種困境,不僅購屋貸款條件較差,未能減輕其購屋負擔,甚至有諸多如土地租金上漲問題、稅賦不合理等,難以預期之風險。且地上權模式住宅屬性複雜,政府政策更迭下,更出現無建物所有權之「使用權住宅」,一般民眾更難以判斷其與「地上權住宅」或一般所有權住宅在權益上之差異。
    地上權模式住宅,同為人民居住之住宅產品,應同一般住宅受政府所保障;且設定地上權模式之所以盛行,系因大面積公有土地不得出售之公有土地政策,設定地上權儼然成為活化國有土地之主要趨勢;地上權模式住宅之相關制度若於合理狀況運行下,應是對於政府與住宅購買者之間達到「住者有其屋、地盡其利」之政策目標,於住宅政策角度而言,亦可釋出可負擔價格之住宅,對於政府、住戶、建商之間屬三贏之情形。改善地上權模式住宅之問題,可健全住宅階梯,並以地上權模式住宅階層作為釋出可負擔價格住宅之中階住宅產品,使民眾能在換屋行為之過程中,透過住宅過濾作用於市場機制中之自由運作,提升各階層民眾居住之生活品質。
    本研究主要探討地上權模式住宅所面臨房貸窘境、土地租金上漲與合理稅賦三大問題,並以訪談研究訪談專家學者就其專業與經驗,給予本研究見解與建議,以探究並釐清地上權模式住宅於我國運行之下之所以面臨諸多困境之原因。而研究發現,在貸款問題中首要為化解銀行對於承作該類住宅融資貸款之顧慮;稅賦部分應適用自用住宅稅率;土地租金部分則需與公告地價脫鉤,並制定符合地上權價值估價之土地租金評定方式。
    Why people choose to buy Superficies-Housing, instead of Ownership-Housing? The main reason is that they can afford this pattern of house with relatively low cost for a period of time. It’s beyond their expectation, however, under government’s manipulation which caused more problems. For instance, the loan -requirement is hard to achieve so they can’t actually reduce pressure of buying Superficies-Housing. Another problem is that the tax rate changes from time to time without acceptable degree which put purchaser under more risk. With the complexity of Superficies-Housing and the change of policy, Usufructuary right-Housing based on the Superficies-Housing appears, which people can’t distinguish rights from the difference of these two pattern’s house.
    Superficies-Housing is one of residential product, so it should be under government’s protection. Why this kind of housing-pattern can become popular is that the government won’t sell the large-area lands for public use, so there is an inclination of using Superficies-Housing to be one of government’s financial resources. When Superficies-Housing is under proper implement, the value of the land can be maximized and everyone in this contract can also get maximum profit. If people have ability to buy affordable houses, it could achieve “win-win” between government, residence, and manufacturer. With improvement of Superficies-Housing policy, it can make the function of Ladder of Housing become more perfect, which can reduce hurdle on trading houses and it may upgrade the quality of peoples’ living.
    This research focuses on how to resolve difficulty of loan, inflation of tax, and reasonable tax rate by interviewing different professionists. Through their expertise, experience and analysis, we can find out why there are quite amount of problems in carrying out Superficies-Housing. This research also shows how bankers think when they decide if the loan is dependable; the tax rate should be equal to residence for own use; lease of land should not be related to government-declared value of land, and design a new criteria for Superficies-Housing use.
