    Title: 音樂著作侵害認定方法之研究

    Abstract: 本論文以「音樂著作侵權態樣的認定方式」為研究核心。「音樂著作」是一 種具有特殊性質的著作類型,在判斷兩系爭音樂著作間是否為「近似」時,如何 將「抽象」的音樂著作類型以「具體」的方式進行判斷則成為一項非常重要的關 鍵點。
    首先,本文將把研究領域分為兩部分:一為「音樂著作之保護」,以「音樂 作品」的組成要素作為「音樂著作」的構成要件,以利於「著作權法」在運用於 「音樂著作」時的保護進行探討,先介紹美國著作權法之相關規定並探討音樂著 作侵權案例,並分析美國著作權法在判斷近似侵權態樣之「Arnstein 原則」以及 「接觸+實質近似」之認定方法等,深入了解著作權法中針對「音樂著作」的學 術、相關法規的建立,並回歸我國在音樂著作近似之侵權案例,針對我國法院及 美國法院處理音樂著作侵權態樣在實務上不同的認定方法,進行優劣及缺失的比 較,以修正我國著作權法目前在實務上對於判斷具「專業性」及「特殊性」的兩 系爭音樂著作是否為近似之侵權態樣的認定方法。
    二為針對「音樂著作」細部之認定兩系爭音樂著作是否構成近似的判斷方法, 本文試圖在此階段的研究跳脫出法律在實務上的認定框架,抽離我國法院及美國 法院對於音樂著作近似之侵權案例認定方法,單純從音樂的本質作為出發點,嘗 試以「音樂作品」的「創作要素」、「曲式風格分析法」、「樂譜比對法」、「音頻分 析法」及新興科技的音樂比對資料庫作為判斷兩系爭音樂著作是否為近似之輔助 方法。
    本文計畫透過此次研究,找出更精確、更具音樂專業性的特殊認定方法,並 期許在未來可以建立一套針對「兩系爭音樂著作是否為近似」之特殊且專業的完 整認定體系。
    This thesis is the core of the research on the identification of the infringement of music works. "Musical works" is a type of work of a particular nature, and judging whether "abstract" music works are "concrete" in judging whether or not the two works are "similarity" is a very important key points.
    First of all, this paper divides the research field into two parts: one is "the protection of music works", and the elements of "music works" are the constituent elements of "music works" in order to facilitate the application of "copyright law" The author discusses the protection of copyright in the United States and discusses the case of copyright infringement in American copyright law and the determination of "Arnstein principle" and "access+ substantial similarity". Depth understanding of the copyright law for the "music" of the academic, the relevant laws and regulations, and return to Taiwan in the music works similar to the case of infringement, for our courts and the United States courts to deal with infringement of music writings in the practice of different identification methods, Comparison of the merits and demerits of the copyright law in order to amend the copyright law is currently in practice for judging the "professional" and "special" two series of music work is similar to the infringement of the identification method.
    The other, the author tries to find out the framework of the legal practice in this stage, and draws a conclusion from the courts of Taiwan and the United States of America about the music works The music composition method, the musical form analysis method, the musical score comparison method, the audio analysis method, and the emerging technology of the musical composition, and the method of identifying the music copyright infringement case is simply based on the essence of music. Music matching database as an adjunct to judge whether the two music works for the approximation of the auxiliary method.
    Through this research, this paper aims to find out a more precise, more specific method of identifying music professionals, and hope in the future can establish a set of "two music works for the approximation" special and professional integrity of the system.
