摘要: | 本文之題目為「論贓物罪-從法本質出發」,茲將其內容分章說明如下:第一章為緒論依序分別說明本文之研究背景與目的、研究方法、研究範圍與限制及概述章節架構,藉以確立本文所欲研究之問題與方向,並藉由介紹本文之初步架構導引出後續各章節之內容。本文僅嘗試自法益為出發點對贓物罪之分析,並就其構成要件,正犯共犯,親屬間竊盜適用範圍進行論證。第二章 就贓物罪之基本內涵展開介紹,先從法益為出發點,確認其法益之內容及贓物罪之規範涵攝範圍。第三章 展開贓物行為之不法構成要件,特別針對其行為、主體、客體等客觀要素,以及主觀上之故意內容(尤其,是否排除間接故意之限縮可行性)逐一申述,當中,對文獻上業已提出之學說各內容,試加引注並予以詳實比較。第四章 探討贓物罪之行為態樣及其既、未遂之判斷標準,並就不罰後行為,正犯與共犯等各相關議題進行評釋。經由上述各章節依次介紹及研究討論後,最終獲致結論。
