    Abstract: 面對現今全球化產業的競爭,台灣已從過往大量製造的工業時代,進入腦力與創意競爭的知識經濟時代。在文化創意產業範疇中,藝術產業扮演著核心角色。
    台灣的「文化創意產業」( cultural creative industries ) ,係指那些來自於創意與文化積累,透過智慧財產權的生成與運用,有潛力創造財富與就業機會,並促進整體生活環境提昇的活動。其中,藝術作品的交易與授權,在文化創意產業的價值鏈中所扮演的,正是連結藝術領域到衍生應用產業的核心關鍵角色,藝術產業已成為文化創意產業中一項核心的產業。
    博物館是帶動文化創意產業的火車頭,國立故宮博物院具有中華民族歷史的傳承特性,典藏的各類文物藝術品,透過藝術授權途徑,近年來故宮在藝術授權的產值方面逐年增長。尤其,隨著政府大力推動國家型科技計畫,故宮為主要執行單位,數位典藏授權業務,在商業化的價值上,更趨多元及寬廣,已然在公有文化資產商品化及加值利用上居於龍頭地位。
    另方面,故宮也因大量利用已無著作權的藏品,而衍生無限價值的新興產業,近年不斷遭到法界人士抨擊,本研究擬就故宮在進行藝術授權作法上,探討與相關智慧財產法規可議之處,並提出可行之建議,以提升故宮及其他博物館、美術館授權機制之效率。
    As Confronted with globalized competitions, Taiwan has undergone a transform from an industrialized society with mass production into an era of knowledge-based economy with brainstorm and competitions of creativities. In the framework of culture creative industry, art production plays a key role in this aspect.
    Culture creative industry refers to a range of economic activities which are concerned with the generation or exploitation of knowledge and information accumulated through creativities and cultural heritage and operated through the practice of intellectual property right, potentially generate profit and employment opportunities, and promote the quality of living environments. Among all the activities, the business transactions and authorizations of art production play a crucial role in the chain of culture creative industry as they bridge art domain and its derivative industries of applications.
    Museums are no doubt to be a bellwether of the culture creative industry. National Palace Museum has inherited an integral part of Chinese culture and history, and it has an ample collection of various relics. Through art licensing, the revenues of art production have increased in recent years. Specifically, the Palace Museum has become a leader in the area of utilization and promoting profit of public culture merchandises as it carries out numerous government technical projects in digital archives and lincensing of art goods.
    On the other hand, the Palace Museum has also been criticized by judicial sectors for generating limitless commercial profits from its collections without any authorization. This study will focus on the issues to be open to objection such as licensing of art production and IPR. Feasible proposals will be suggested to the Palace Museum and other museums in an attempt to promote the efficiency of the mechanism of licensing of art production.
