    摘要: 台北市經過一百多年的發展,已面臨都市逐漸老化窳陋的問題,面對現在台灣社會人口高齡化及少子化影響,政策從擴大都市計畫轉化為以老舊社區都市更新為主軸,卻面臨整合不易的困窘。
    本研究發現都更過程存在有公共財的供給之三種賽局,即「鬥雞賽局」、「智豬賽局」、「囚徒困境」。本研究試圖釐清是何種因素造成協調困難的原因,逐漸理解問題不在於溝通不良,而在於權利人的心理因素可能是問題癥結的主因,因此以精神醫學研究為本提出Anti-commons成因之新假說。
    本研究認為租隙理論架構不夠清晰,存在難以驗證的問題,因此提出「新租隙理論」試圖釐清租隙理論之概念與解決租隙如何加以驗證之方法,將舊有的租隙分離為兩種,區分成「狹義租隙」(narrow rent gap)與「廣義租隙」(broad rent gap)兩種,使租隙理論之尺度的標度不致於產生混淆,易於識別從而容易驗證。本研究提出「重建租值獲利線」(Reconstruction profit of rent)之新創見,探討潛在租值之大小是否對都更能否實施具有決定性之影響。本研究提出新創見「容積獎勵與潛在經濟租值的消散及回復概念圖」,探究如何透過都更容積獎勵制度,使得消散的潛在經濟租值回復之過程,以及住戶與建商之間如何分配這些回復後的租值。
    本研究在法律經濟面探討中,以美國法律經濟學之研究為本,探討都市更新之法理學問題,從波斯納的理論與方法,面對多數決的都更同意比,在多數決與所有權之間如何衡平的兩難問題。
    本研究結合相關參考文獻之論點及「賽局理論」與「法律經濟學」為分析觀點,闡明法令制度面與執行面不足之處予以建議配套措施,使都市更新之美意能在公正、公平及公開下實施,使老舊社區能改頭換面成為都市未來發展之契機。
    Taipei city is facing on aging problems after hundred years of development. Taiwan now is facing on the effects upon aging society and declining birthrate. The main urban renewal strategies are transformed from city expansion into revitalization of communities, but still face the perplexed situation of integrated problem.
    This research have discover in urban renewal processing exist three kinds of game which is“Chicken Game”,“Pig Game”, and“Prisoner's Dilemma”and all correlation with the supply of public goods. This study involved in-depth observation of urban renewal, trying to clarify what kind of factors are the reasons why so difficult to coordinating with legal estate proprietor. And gradually understanding the problem does not lie in poor communication, but in the legal estate proprietor’s psychological factors may be is the main cause of the perplexed situation. Therefore raise a hypothesis about the cause of anti-commons base on psychiatry.
    This study deems the frame of“Rent Gap Theory”not distinct and exist problem of hard to verification. Therefore raise a new rent gap theory trying to clarify the concept of rent gap and method of how to testifying. By divided the rent gap into two kinds of rent gap which is“Narrow Rent Gap”and“Broad Rent Gap”, so that the rent gap theory without confused and easy to identify and verify. This study raise a new transcend which is“Reconstruction profit of rent”, to discussion of whether the size of the potential rent have decisive influence on implement of urban renewal. This study also raise a new transcend which is the map of“Potential Economic Rent Dissipation and Recovery by Bulk Reward”. Explore how to use the bulk reward to recovery economic rent and how to allocate the rental value between these households and the construction company.
    In the phase of economics analysis of law of this study, based on American’s economic analysis of law, explore the jurisprudence onto urban renewal. From the thesis and method by Richard Allen Posner which is facing the dilemma between property right and majority, how to equity this dilemma.
    This explores combines the related references, “Game Theory” and the theory of “Economics Analysis of Law” as the viewpoint. Reveal the supporting suggestion of law and executive aspects; unveil the transfiguration of deteriorating neighborhood community, so that the original fine purpose of urban renewal as a turning point for city development which practice under public, equity, and justice bases.
