摘要:	兩岸開放以後，海峽兩岸人民往來日趨頻繁，難免會牽涉到中國大陸地區政府的行政行為，了解中國大陸地區之行政法制，變得愈益重要。在這種情況下，研究中國大陸政府部門行政制裁當屬重要，本文乃就中國大陸現行行政處罰制度，擇《行政處罰法》為研究對象。本文除分析大陸行政處罰制度之建制、功效、理論基礎與發展，並就《行政處罰法》法條展開全面性的研究；另以《行政處罰法》中與我國〈行政罰法〉相較下具有特殊性之領域為研究議題，分別就《行政處罰法》中「委任立法」、「相對集中行政處罰權」、「罰鍰不二罰」、「聽證程式」等四部分為論述，並提出完善之建議。 After the development of cross-strait relations. More and more Taiwanese have a round-trip within cross-strait. Gradually, it is unavoidable to be involved in administrative conduct in Mainland China Area. To relize the Administrative Law in Mainland China Area is important for Taiwanese. Under such circumstances, studying on the Administrative Penalty Law in Mainland China Area is significant nowadays. This thesis studys on the form, effect, theory, development and the whole content in Administrative Penalty Law. Furthermore, this thesis still makes a comparison and analysis with Taiwan area also, including “Delegated legislation”, “Relative Concentration on the Authority of Administrative Penalty”, ”NO Double Jeopardy on Fine’’,” Hearing Proceeding”.
