摘要: | 土地徵收屬於公用徵收(憲法第108條第1項第14款)的一種,係國家為興辦公共事業或實施國家經濟政策,實現公共需要(Public Necessity)或公共用途(Public Utility)目的,而無法以其他方式取得私人土地權利時之最後手段,惟須對特別犧牲之被徵收土地所有權人,應予以相當之補償。民國101年1月4日總統令修正土地徵收條例公佈施行,該條例之修正重點除強化憲法上公益與比例原則外,亦針對徵收補償之規定加以修正,希望能達到對被徵收土地權利人完全補償之目的。
本研究藉由相關文獻及法令規定與國內外案例之探討,個案以苗栗大埔土地徵收案為對象,研究方法以文獻分析、案例分析、德爾菲法為主軸,希望透過專家問卷,達到以下幾點目的:(一)瞭解各領域的專家學者對我國土地徵收評估指標建立與應用;(二)瞭解國外土地徵收法制規定與案例判決,提供我國未來修法參考(三)利用德爾菲專家問卷,歸納分析土地徵收評估指標之項目,進而提出本研究策略與建議。
Land Expropriation is one of the Expropriations for public use (according to the Constitution Art. 108.1.14). It is for the Department of State to construct public utilities or implement national economic policies in order to achieve purpose of Public Necessity or Public Utility, and it also is the final method when acquiring private land ownership are all failed. Only when landowners subject to the special sacrifice expropriation should be given considerable compensation. Presidential promulgated Amendments to the Land Expropriation Act on January 4th, 2012. The main amendments to the Act is strengthening the focus of public welfare and the constitutional principle of proportionality, but also to expropriated compensation. Hope to achieve the purpose of completeness compensation to expropriated-landowners.
This study which related to documents ,law-regulations and domestic/foreign case studies, is base on expropriated case in Miao-li, Tai Po and use the method of research on document analysis, case analysis, and Delphi method as the main theme through expert questionnaire to achieve following objectives: (a) understand the experts and scholars in various fields on Land Evaluation Index establishment and application; (b) understand the law-regulation of land expropriation, and case studies abroad provide amending the law for future reference (c) use the Delphi questionnaire to induct and analysis the project of land acquisition assessment indicators, and the study puts forward strategies and recommendations. |
