Abstract:	各國為行使主權，維護國家安全及利益，防止偷渡犯罪或不法情事發生，通常運用國家統治權與管轄權，施行境管制度。設機關、置人員，建立有組織、有系統之管理機制。除對入出國境人員進行查驗管制外，對外國人入境後之居停留亦加以查察管理。我國同樣設有境管機制，惟因兩岸間的特殊關係，衍生我國對大陸地區人民來台另設不同機制進行管理。近年來，國際社會及各國政府對於人流入出境議題相當重視，尤以偷渡、假結婚、假探親、假探病、假觀光、假漁工、假專業交流及使用假證件等各種手法矇混闖關所衍生之政治、經濟、社會、衛生、犯罪及人權保障等相關問題，更受到矚目與關注。兩岸間由於歷史因素、政治對立、社會制度不同導致四十年的隔絕。後因客觀環境變遷，台灣於1987年開放兩岸間的交流往來，也無可避免地發生了上述負面問題，亟需有關當局思考與提出因應對策。國內外學術界對境管議題研究不多，與本論文主題契合之專著或學術論文大抵闕如。官方資料常加以管制，或對外保密，僅能從散見於其他論作中擷取相關見解，再融入筆者十餘年實務經驗觀點及蒐集之資料加以論述。所幸筆者服務境管單位之便，尚能運用內部資料、案例進行分析及實務運作觀察等方法，進行綜合性探討及實證研究。本論文主要論述架構與內容為：全文分列六章，第一章緒論，說明研究動機與目的及研究方法、範圍、名詞界定等。第二章針對大陸地區人民合法入境台灣地區之管理現況先予檢視分析，第三、四章接著對合法掩護非法及非法偷渡入境台灣之情況及因應措施進行檢討論述，第五章進一步對影響大陸地區人民入境台灣之管理成效問題進行探討，最後提出研究心得及發現：政府基於兩岸情勢發展與人民需要開放雙方人民互動往來；針對大陸地區人民來台而發展出一套有別於國人或外國人之管理機制；大陸人民來台意願高；假藉各種名義來台者不少；從事不法行為亦多。因此，健全大陸地區人民來台管理機制，以達服務、效率、安全兼顧的有序管理境界，正是本論文研究之目的。為此，本論文從政策、實務、法律、學術及整體等五個面向提出建議，期能提供政府、實務單位及學術界參考。 States in the exercise of sovereignty and safeguarding national security and interests, and prevent violations of human smuggling or illegal, usually with the jurisdiction of the State authority, the system of border control. In recent years, the international community and all Governments for people to exit the question quite seriously, particularly smuggling, false marriages, family leave, leave ill, false sightseeing, false labor, false professional exchange and the use of false documents, and other practices derived through way through our checkpoint of the political, economic, social, health, crime and the protection of human rights and other related issues, but also by the attention and concern. Cross-strait due to historical factors, the political opposition, leading to 40 years from different social systems. Changes due to objective circumstances, the Taiwan strait in 1987, opening up the exchanges between the exchanges, but also the negative inevitably occurred, the authorities need to reflect on and propose countermeasures. And academic research are subject to border control, and the papers carrying the theme of monographs or articles probably nothing. Official data often control, or external secrecy, only from the scattered across the other theory, capture relevant insights for further integration into the author of more than 10 years of practical experience and perspective to be dealt with the collection of data. Fortunately, the author of units will service territory, able to use internal data, case analysis and practical methods of observation, and comprehensive empirical research to explore. This paper addresses the main structure and content : text disaggregated six chapters, the first chapter introduction on the purpose and motive of the study and research methods, scope, terms defined. Chapter II against mainland people's legitimate entry of Taiwan status ensures management review analysis, three, four chapters proceeded to cover legal and illegal smuggling of illegal immigration Taiwan situation and response measures reviewed exposition chapter further impact the area Immigration Taiwan management effectiveness explore final research experience and found : Based on the opening of cross-strait developments and the needs of the people interaction between the two peoples; to the people of Taiwan against the mainland and developed a different country or foreigners management mechanisms; people on the mainland to Taiwan will high; Many nations of the name of Taiwan persons; engaged in wrongdoing occasion. Therefore, the people of mainland China to Taiwan sound management mechanisms to achieve service, efficiency, safety, balanced and orderly management realm is the purpose of this research papers. To that end, the papers from the policy, substantive, legal, academic and overall five-oriented recommendations, with a view to providing government, and academia substantive units reference.
