摘要: | 72年以前非都市土地開發,僅需檢具水土保持計畫書向水土保持機關申請核可後,就可持水土保持機關發給之水土保持完工證明,向地政機關辦理變更編定為丙種建築用地即日後所稱的「老丙建」。
依87年內政部營建署完成調查資料顯示,國內「老丙建」土地面積多達七千餘公頃,且位於山坡地。老丙建住宅社區土地一般僅經過初步整地而已,大部份未有完善水土保持設施,且部分使用中之社區設施,因登記作業欠缺明確法令規定,以致在後續變更及管理階段,社區設施用地因產權登記及使用權不明確,而普遍發生管理糾紛,進而衍生社區生活及居住環境品質問題。
本文嘗試從土地登記管理的角度,探討目前使用中之社區設施用地,開發時相關登記規範,期對於老丙建社區設施用地之登記管理提出合理可行之對策建議,以作為後續修法之參考。基於上述緣由,本文共5章20節,僅摘要各章略述如下:
第一章緒論。首先說明萌生研究心境之緣起、動機、目的,續陳研究範圍與內容、研究步驟方法流程、關鍵詞界定等。
第二章文獻回顧。先陳述社區設施用地登記管理概況及其發展沿革,繼而探討登記管理機制、登記管理作業實務、相關研究論文、找出社區設施用地登記管理之通則。
第三章實證調查。首先建立調查架構與調查計畫(研究架構及研究方法論述),續說明實證個案現況、調查問卷設計與調查要項,最後針對問卷調查資料做統計整理。
第四章課題與因應對策。就社區設施用地登記管理方式問卷調查之結果與第二章所找出的通則加以詳細分析,尋找社區設施用地登記管理的問題,再針對所歸納的問題整理出議題並研擬課題與可能因應對策,並經深入訪談提出可行對策。
第五章結論與建議。說明本文之發現、貢獻與價值,並提出後續研究之建議。
Before 1983, the land development of non-urban only needed to submit soil and water conservation proposal to the competent authority to apply for approval and then may hold the completion certificate of soil and water conservation issued by the competent authority to land office to change the category as Class C building land as the so called “Lao-Bing-Jien” thereafter (hereinafter referred to as “Lao-Bing-Jien”).
According to the investigation information completed by Construction and Planning Agency, Ministry of Interior in 1998, which shows that the land areas of domestic “Lao-Bing-Jien” have reached more than 7000 hectares and are located at hillsides. Generally, the land for Lao-Bing-Jien residential community only needed initial leveling, most of which were without well-done soil and water conservation facilities, moreover, portion of the community facilities in use, the registration operation of which was deficient in clear statute regulation, and further caused the consequential change and management stage., because of title and ownership registration and unclear in right of use, the management dispute was occurred generally, and further incurred the living and residential environment quality problem of community.
The text tries to study the community facilities in use currently, its land and the related registration norm while development from the viewpoint of land registration management in order to provide an reasonable and feasible administrative suggestion to the registration management for the land of Lao-Bing-Jien community facilities and is to be provided for the reference of consequential law amendment. Based on the above mentioned grounds, the text totally has 5 chapter 20 sections, and is abstracted as follows:
Chapter 1: Preface. Firstly, it describes the origination, motivation, purpose of this study, secondly, it describes the scope and contents of study, study steps, method, flow process, and the definition of keywords.
Chapter 2: Literature recall. Firstly, it describes the general status of land registration management for community facilities, and then to investigate the related statute for land registration management of community facilities, the related study thesis so as to find out the general rules of registration management for land of community facilities.
Chapter 3: Verification investigation. Firstly, it establishes an investigation structure and investigation plan( description of study structure and study method) , secondly, it describes the current status of individual case verified, design of investigation questionnaire, and investigation items. Finally, it targets the investigation information of questionnaire to make a statistic arrangement.
Chapter 4: Topic and responding measures. To analyze in details in respect to the result of questionnaire investigation on the land management method of community facilities to find out the problem of land registration management of community facilities, and then to target the issue from the problems induced to propose a defined topic and possible responding measure and to provide a feasible responding measure by having through interview in depth.
Chapter 5: Conclusion and suggestion. It describe the finding, contribution, and value of this text so as to provide suggestion to the consequential research. |
