資訊公開於現代社會,實為人民形成自我意見與建構個人圖像所不可或缺者,同 時,自人性尊嚴及人格權保障面向觀察,資訊隱私權的重要性亦不容小覷,因而,如 何在追求人民知的權利的同時,亦兼顧個人隱私權之保障,即有其重要性。 本研究由基本權利客觀面向之組織保障功能出發,嘗試引介德國資訊監察制度,就 其同時肩負資訊公開及個人資料保護雙重責任之運作模式及組織架構進行探究,並依 據資料類別之不同,擇二深入介析:其一為依據聯邦個人資料保護法(BDSG)以及聯 邦資訊自由法(IFG)所建構之「聯邦個人資料保護及資訊自由監察機構(BfDI)」,其 就相關機關一般性蒐集、處理或利用個人資料及公開資訊之行為進行監督並提供諮 詢;以及前東德國家安全局基於國家情報網絡建置及治安維護必要,而廣泛蒐集之個 人資料,由於該等資料往往具有高度敏感性,故依據前東德國家安全資料法(StUG) 設置「前東德國家安全資料監察機構(BStU)」,就上述資料之蒐集、保存與利用,專 司監督及評估之責。觀諸我國政府資訊公開法及個人資料保護法等相關法制,尚未有 透過組織建置,衡平資訊公開及個人資料保護之制度設計,期待透過本研究之成果, 得提供一新的視野與思維方向。 By providing access to public information, everyone has the opportunity to educate his own opinion. Due to the protection of human dignity and the possibility of free development of the individual, the right of privacy needs also to be considered. It leads to the question whether through the establishment of organization and procedure might be a proper answer to achieve the goal of protection to the both fundamental rights, the right of privacy and the right of access to public information. Object of the present research would be the role of the information supervision Institution in Germany. Two kinds of federal commissioners will be discussed: The Federal Commissioner for Data Protection and Freedom of Information (BfDI) as well as the Commissioner for the Records of the State Security Service of the former German Democratic Republic (BStU). The BfDI is according to federal data-protection law and federal public-information law, an independent control-body, which is in charge of the supervision of the government related departments as well as of companies within the telecommunications and postal services. The BStU, however, is fundamentally related to the Stasi-Records law, and responsible for the collection, disposal and administration of the records of the Ministry for State security at the former German Democratic Republic. There are no similar institutions as the BStU or BfDI in Taiwan to date. However, it is trusted that by the presentation and discussion of the present research, a fresh perspective can be offered by considering above mentioned protection of the right of privacy and access to public information as fundamental rights.
