    Abstract: 傳統社會莫不認為有土斯有財,先成家再立業,而成家的第一步,就是要擁有屬於自己的房屋,因此,房屋之買賣交易,已是一生中不可或缺重要目的。然而,不動產各別差異性很大,難以建立一個公開的市場,提供一般人所需的完整資訊,因此,在資訊不流通與不透明的情況下,極易產生資訊不對稱的問題,加上專業人士之素質良莠不齊,往往利用其掌握資訊之優勢,對於交易當事人隱藏重要資訊,甚至欺罔之行為等事件發生,致不動產交易紛爭案件層出不窮。
    消費者購買房屋透過不動產仲介業者購買已是日前社會常態,然而當仲介業者未確實對成屋的瑕疵進行調查並告知消費者時,糾紛因而生起。本論文研究方向有二:(一)探討不動產說明書在我國不動產仲介業者在交易安全上的地位。(二)探討政府所頒布的成屋不動產說明書應記載及不得記載事項內容及說明主體為何,又常見的成屋仲介買賣實務糾紛為何,例如:未提供不動產說明書、契約審閱權、廣告不實、產權不清問題、停車位相關問題、公寓大廈管理相關問題、建築物瑕疵問題、重要交易條件等問題,而至今實務見解仍歧異的凶宅問題,以及不動產仲介業者的相關法律責任。
    In the traditional society, the concept of “Possessing Property Makes Wealth” is deeply in the heart of our people. However, the conditions of real estate are varied; therefore, it is difficult to establish a public market to provide sufficient and transparent information. Hence, under the situation of short of communication and non-transparency of data, it is possible to cause the information unsymmetrical. Moreover, due to different backgrounds of Realtors, Realtors who have privileged information may intend to conceal the important transactional information from consumers or even to commit fraud...etc. Therefore, the real estate business causes transactional conflicts frequently.
    Consumers purchasing a house through the real estate agency has been a social norm recently. However, when an agency does not duly investigate the defects of house and inform consumers accordingly, the dispute will arise. This thesis focuses on two aspects: (a) to investigate the status of our real estate agency specification in the transactional security; (b) to discuss the requirement and non-requirement in the real estate specification issued by Taiwan government, as well as the common practice to the transactional dispute on house broker, such as the negligence in not providing the real property specification, the rights for contract review, false advertising, issues of unclear property rights and parking, the dispute of the management of apartment, building defects, important trading terms and conditions, issues of haunted houses, and the related legal obligations of real estate agency.
