摘要:	國際上對於環境與貿易議題已有多方討論，本文希望從重要國際組織所定關於貿易與環保或綠色貿易的相關規範中，分析目前國際間對於本議題的共識或發展趨勢，更進一步希望發現國際社會未來的走向，以幫助提升我國的綠色競爭力。首先本文先介紹現今重要的國際組織針對環境與貿易議題的討論，以及促進永續發展的相關政策的發展，像是世界貿易組織(World Trade Organization，以下簡稱WTO)設立環境與貿易委員會(Committee on Trade and Environment，以下簡稱CTE)，並廣邀會員加入共同為貿易與環保議題討論和交換意見，凸顯出環境保護與經貿發展兩者並重，一昧追求貿易自由，會對環境造成永久損傷，環境無法恢復經濟成長當然就無法持續。其次介紹綠色貿易與綠色貿易障礙的差別，讓我國在發展綠色貿易之餘，不會讓他國有綠色貿易障礙的疑慮，並且再從規範面介紹WTO中與綠色貿易相關的規範，像是WTO框架下的各種不同的協定中與綠色貿易相關的規範，另外介紹目前國際多邊環保協定，特別是附有貿易條款確保公約目標的協定。最後分析目前國際間對於綠色貿易議題的共識或發展趨勢，幫助我國提升綠色競爭力。 This issue of green economy and international trade is gaining important in international debates. Although the concept of green trade is becoming more accepted in the global community, it is still not well developed. Can international organization, such as the World Trade Organization (WTO) influence sustainable development outcomes? This article aims to discuss that trade can be one of solutions for enabling the green economy in the context of sustainable development. Chapter One will preset a brief introduction of this thesis. Chapter Two will explore the relationship between trade and sustainable developments under international legal system. Chapter Three will further discuss the applicable WTO legal instruments about trade and sustainable development. Chapter Four will explore possible solutions for encouraging green trade, especially under WTO trade rules. Chapter five will conclude with recommendations at both international-level and national-level.
