    摘要: 近世紀以來,由於建築科技不斷推展,促使建築物往高層化發展,因而產生區分所有權制度,土地使用與管理型式亦逐漸由水平化趨向於垂直化。
    為清楚瞭解區分所有建築物土持分樓層分配使用管理於規劃面、使用面及管理面之發展與困境,本探討以新北市土城區仁愛住辦混合大樓為例,佐以問卷調查及專家訪談,分析其土地持分樓層使用管理現況與障礙。
    本探討先就建築物土地持分樓層分配,於法規上與使用上之合理性與公平性進行調查分析,次就公寓大廈樓層土地持分使用管理之需求性與適宜性,及其所衍生法規面與現實面落差之問題,對區分所有權人或住戶進行問卷調查,復以其調查所得之問題及值得討論之議題,對不動產產、官、學三方專家實施深度訪談。最後透過問卷調查之統計分析與相關議題、課題、因應對策深度訪談之結果整理,提結論與建議。
    本論文共分五章二十一節,茲摘述各章節內容如下:
    第一章 緒論:首先論述建築物土地持分樓層分配使用管理探討之緣起、續陳探討之動機目的、範圍內容、步驟方法流程與關鍵詞界說。
    第二章 文獻回顧:針對探討目的,從建築物及基地使用管理權之發展沿革、建築物土地持分樓層分配使用管理之相關法規、建築物土地持分樓層分配立體使用管理權能關係等面向,探討建築物土地持分樓層分配使用之合理性、公平性,土地持分樓層使用管理之需求性、適宜性,及建築物滅失後土地持分立體區位、價值之延續性、保障性等,建立本探討之架構。
    第三章 實證調查:以新北市土城區仁愛住辦混合大樓為例,針對該社區大樓土地持分樓層分配使用管理現況,研擬調查計畫、問卷設計及專家訪談內容,並進行其調查分析與訪談結果整理。
    第四章 課題與因應對策:對第三章之實證調查結果,與第二章之一般規律比較,分析其差異所顯示之問題,再就值得討論之議題,透過專家訪談研擬建築物土地持分樓層分配使用管理之相關課題與因應對策。
    第五章 結論與建議:從過去到現在,有關建築物土地持分樓層分配使用管理法規面與現實面落差所衍生之課題與因應對策提出結論與建議,供日後投資興建者於產權規劃面、社區管委會於使用管理面及行政機關於法規執行面之參考與依據。
    During the recent century, because the uninterrupted development of construction technology, which has caused the architecture to the development of high stories, and thus to generate the division of ownership system, the form of land usage and management also has the trend from horizontal to vertical.
    In order to clearly understand the planning aspect of usage management on the stories allocation of building’s land ratio, and the development and hardship of usage aspect and management aspect, the study is as an example of Jenai residential and office mixing building located at Tucheng Dist., New Taipei City, plus questionnaire investigation and interview with expert to analyze the current status of usage management of stories allocation of land ratio and its obstacle
    The study is firstly to aim at the stories allocation of land ration of architecture to proceed reasonableness and fairness on usage stipulated by statute, secondly, to aim at the demand and properness of usage management of land ration of stories in apartment and the problem of difference incurred from statute aspect and reality aspect to proceed questionnaire investigation of owner or residential household., and then to implement a visiting and interview to the experts of industry, government authority and scholar on the issue of problem obtained from investigation and the issue worthy to discuss, finally, by having through the statistical analysis of questionnaire investigation and the related issue to arrange the result of responding measure, conclusion and suggestion are as follows:
    The thesis has totally divided into 5 chapter and 21 sections, the contents of each chapter and section is abstracted as follows:
    Chapter 1. Preface: Firstly, to describe the origin of investigation and study of usage management of stories allocation of land ratio of architecture, and the motivation and purpose of continuous stud, contents of scope, step method, flowing process, and interpretation of keywords.
    Chapter 2: Literature recall: To aim at purpose of study, to investigate reasonableness, fairness, demand and properness of usage management from the development history of usage management of architecture and site land, and the related statute of usage management of stories allocation of building’s land ratio, and dimensional division of land ratio after extinguishing of architecture, and the continuousness and protection of value in order to establish the structure of this study.
    Chapter 3. Verification investigation: As an example of Jenai residential & office mixing building located at Tucheng Dist., New Taipei City to aim at the current status of usage management of stories allocation of land ratio of the said community building to propose investigation plan, questionnaire design, and the contents of visiting and interview with experts to proceed investigation analysis and arrangement of visiting and interview result.
    Chapter 4 Topic and responding measure: To aim at the result obtained from verification investigation obtained from Chapter 3 to compare with the general rule of Chapter 2, and to analyze the problem shown by its difference, and then to aim at the issue worthy to discuss, then by having through visiting and interview with exerts to propose the usage management of stories allocation of architecture related to topic and responding measure.
    Chapter 5 Conclusion and suggestion: From past to present to propose conclusion and suggestion of topic and responding measure incurred from the difference of statute aspect of stories allocation of stories allocation of building’s land ratio with the reality aspect for the reference and compliance of community management committee , usage management aspect, and administrative authority on the execution of statute thereafter
