Abstract:	多數研究聚焦於專利研發指標與研發支出金額探討，至於專利訴訟對市場衝擊之分析則相對較為匱乏。然近年來專利侵權案件層出不窮，部份公司進行專利佈局時，因缺乏有效稽核佈局成效，導致專利的防禦與攻擊皆不足，智慧財產未能充分發揮效果，反遭致產業鏈上下游企業以授訴訟方式進行商業競爭，陷入漫長的侵權訴訟過程，不僅牽動企業股價變動，更反映投資人信心與投資行為。為此，透過競爭分析了解產業鏈間專利侵權訴訟之市場反應結構為重要課題。 Patent infringement cases are growing in number. Lacking in effective reviews of layout effectiveness, some companies are inadequate in patent defense and attack regarding patent layout. As a result, intellectual properties cannot be fully used. Instead, the upstream and downstream members of the industrial chain utilize litigation in businesscompetition, leading to long processes of patent infringement litigation. If a company isunfortunately defeated in litigation, the company not only has to pay a large amount of royalties, franchise fees, or damages, it may also be forced out of the market. At present, enterprise resource configuration is closely related to market information efficiency, which is not only related to the company value in the market economy, it also reflects the confidence of market investors and investment trends. Therefore, using dynamic competitive framework to analysis the market reaction structure of patent infringement litigation between industrial chains is obviously an important issue to the government, the academia, and the industry.
