    Abstract: 本計畫旨在研究法系起源與法律繼受二者對反托拉斯執法績效之影響。研究方向與預期結果為:法系起源對執法績效之影響係決定於法律繼受國是否能接受移植自西方的法律制度,一個成功的法律繼受需要繼受國的政經制度能支持並維護其所繼受之反托拉斯規範體系。如果繼受國無法跨越此一制度門檻,則競爭法之實施將無法改善市場競爭,法律繼受也將失卻意義。此時,無論繼受國之法律制度係源自歐陸法系或是英美法系,均不會對反托拉斯績效有所影響。
    This project investigates how antitrust effectiveness is associated with both legal origin and transplant effect occurring in the process of antitrust transplant. The research design and expected results are that the impact of legal tradition on antitrust effectiveness depends on whether or not the country is receptive to the transplanted antitrust regime. A successful antitrust transplant requires institutional structures in host countries that could support and maintain transplanted laws. If the transplant country fails to meet this institutional requirement, then the enforcement of competition law will have a very limited effect on improving market competition and its transplantation will be neither harmful nor helpful in terms of law enforcement. At this point, no matter in what legal tradition the antitrust judiciary appears, there is little correlation between legal origin and antitrust effectiveness.
