    摘要: 容積移轉源自於歐美國家為保護文化資產、自然環境及生態保育等所創設發展權移轉制度之特性,台灣將其擴充至全面性適用範疇與市場化,企圖解決長期以來中央與地方政府深陷公共工程建設財政困境壓力,提供建築規劃設計與產品型態朝多元化之方向發展,對於促進房地產市場景氣逐漸活絡,帶動土地投資熱潮,形成一波刺激效果,國內各縣市容積移轉申請情況相當踴躍,實構成深入研究的理由。
    容積移轉主要是應用於處理古蹟、歷史保存區與環境敏感地區之保存,並輔助都市計畫事業(如都市更新)或都市成長管理計畫之推行。而在台灣卻因為政府長期受困於公共設施保留地取得的問題,將容積移轉的適用範圍擴大,而應用於公共設施保留地取得。容積移轉為都市成長管理中,可供靈活運用之執行工具之一,國內自1990年以後基於政府財政考量,1999年發佈「都市計畫容積移轉實施辦法」,有關容積移轉制度終於有法令可依循。此外,2002年都市計畫法部分條文修正案公布施行,其中第八十三條之一增訂條文明定容積移轉實施辦法之法源依據。
    本研究探討代金繳納方式執行對容積移轉組織構造、運行原理對都市發展影響、課題及修正建議,提供未來容積移轉制度改良或推動之參考。
