    摘要: 二次大戰後,女性投入勞動市場已成為經濟持續發展的趨勢之一,但在東亞傳統價值觀的束縛,以及兩性先天生理條件的差異下,職場上對女性不友善的環境與限制時有所聞。為落實憲法中對人權的保障,我國先於2002年施行「性別工作平等法」,再於2008年修正名稱為「性別工作平等法」,以日本「男女僱用機會均等法」為師,積極推動兩性平權,創造更為進步和諧的社會。
    本論文研究目的在於就我國與日本的性別工作平等法制度加以比較,分別自源起及立法過程追本溯源,再從兩國性別工作平等法制度的架構、規範功能切入研析,並探討施行後所面臨的問題。最後透過兩國性別工作平等法制度的研究分析,探索先於我國施行的日本法制值得我國參考之處,並針對我國現行性別工作平等法制度,以切合我國國情及面對問題角度出發,做出總結及提出個人建議。
    研究發現日本近年來的制度發展,特別是在於實務案例與基本概念的釐清上,以及日本政府在面對性別工作平等法制度時,所相應而生的政策規劃,確有值得我國參考之處。反觀我國,未能明瞭「徒法不足以自行」的真諦,不積極推動配套措施,主導並落實性別平權觀念,體現性別工作平等法的立法意旨,實乃美中不足之處。

    Since the end of World War II, female participation in the labor market has become one of the trends in sustainable economic development. Nevertheless, due to the constraint of traditional values in East Asian cultures and the variation of congenital physiological conditions between the male and female, the unfriendly environment and constraints for women in the working place are commonplace. In order to realize the protection of human rights specified in the Constitution, making reference of the “Law for Equal Employment Opportunity of Men and Women” implemented in Japan, the government of our country promulgated the “Gender Equality in Employment Act” in 2002, of which the name was changed to the “Act of Gender Equality in Employment” in 2008, to actively promote the concept of gender equality and create a more progressive and harmonious society.

    This study aims to compare the gender employment equality systems implemented in our country and Japan, by tracing to the origin and process of the legislation, analyzing the framework, regulations and functions of the gender employment equality systems implemented in both countries, and exploring the problems faced by both countries after implementation of the systems. Finally, this study probes into the more advanced Japanese system to identify the parts that are worthy of reference by our country, as well as summarizes and proposes recommendations for improving the current gender employment equality system in our country based on the real national conditions and the problems faced by our country.

    The results show that there are indeed some parts that are worthy of reference by our country in terms of the development of the Japanese system, particularly the clarification of practical cases and basic concepts, and the policies and plans formulated by the Japanese government to cope with the implementation of their gender employment equality system. Looking back at our country, it is really a blemish in an otherwise perfect thing that, failing to understand the meaning of the saying “Laws alone cannot carry themselves into practice”, the government has failed to actively promote supporting measures, lead and realize the concept of gender equality, and embody the legislative intent of the “Act of Gender Equality in Employment”.
