Abstract:	因為民法繼承編於民國96年12月14日及97年4月22日修正民法繼承編及施行法之規定，創設了當然繼承制度下之法定限定責任，又於民國98年5月22日修正民法繼承編，採行「概括繼承有限責任」為原則。為了解決目前少數的社會現象，而這兩次的修法時間間隔過於簡短，並未考量現行社會的狀況就倉促立法，且沒有考量配套措施及新法施行後對社會的影響可能會產生許多問題，繼承制度影響社會巨大，故擬評析民法繼承編兩次修正的得失，對於社會所造成的影響及衝擊，以及實務的因應措施來做闡述，並提出進一步的修法建議，希望能作為將來修正繼承法的參考。 The Succession Law of Civil Code amended on December, 14 of year 96 and April, 22 of year 97 of the Republic, and constituted the statutory limited respondibility of Natural Succession.The provision of Succession law of Civil Code on May, 22 of year 98 of the Republic adopted universal succession and limited responsibility.The two Law provisions which amended in a short period of time are only for minor social phenomena.Under the circumstance, the law provisions did not consider the situation of modern society, supporting measures, and the problems caused by execution of new law.Due to the Succession Law of Civil Code having a great impact on society, the thesis inclines to evaluate the social influence and conflict resulted from the pros and cons of the two law provisions.The thesis also elaborates the measure applied to practical situation, and move further to propose the suggestion of law provision.The researcher expects the research result can be applied as the resource of Succession Law provision.
