摘要: | 在實施都市更新過程中,必須選擇實施者。實施者依其領域又分為民間和政府主辦,民間主辦大多以建設股份有限公司及開發股份有限公司擔任實施者為多,而少數案件則由所有權人自行籌組都市更新會,擔任重建社區之任務。在都市更新作業推動中,實施者扮演角色極為重要,其功能在於協助所有權人更新前所有權人更新意願的調查、所有權人的整合,更新計畫報核後相關審議及計畫內容修改,乃至權利變換計畫發佈實施後產權移轉、權利配回等等之事項,不僅涉及各專業領域間協調整合,更於更新範圍內所有權人、政府機關及都市更新委員會之間肩負起溝通協調之功能,因此實施者對於推動都市更新而言是非常重要的。
根據各縣市政府「依都市更新條例提出申請之都市更新案件」統計資料顯示台北市的104件中以93件為建設公司辦理,9件為更新會辦理,2件為政府辦理。從上述的結果可以發現,大多數實施者還是由建設公司擔任居多,次多為所有權人自組更新會擔任實施者,至於政府部門擔任實施者主導都市更新案件是寥寥無幾。在「尚華仁愛大樓都市更新案」中,東亞建築經理股份有限公司除了受委託協助財務規劃外,亦藉由建築經理股份有限公司累積之專業經驗,辦理其他項專案服務,而原以推動建案履約管理等不動產業下游市場之建經公司,逐漸在都市更新事業中嶄露頭角,並有積極連結不動產上游市場,力求轉型與擴大經營,並漸漸代替所有權人成為所謂的「代理實施者」。
本研究目的在於探討近年來興起之建經公司,於擔任代理實施者協助所有權人辦理都市更新作業,與委託建設股份有限公司擔任實施者及所有權人自組更新會擔任實施者,三者之間作角色分析,以了解實施者與代理實施者推動都市更新之角色與功能、探討實施者與代理實施者主導都市更新課題與策略、比較實施者與代理實施者對於推動都市更新時之優缺點等目的,並藉由探討實施者與代理實施者在執行都市更新時相關文獻,歸納實施者與代理實施者在推動都市更新中有關之課題;並分析國外都市更新案例中,美國、日本在推動都市更新時不同實施者所造成的影響。
接著透過深度訪談法了解都市更新辦理重建時,實施者與代理實施者在辦理都市更新所遭遇的問題,做分析歸納後,將其課題做為德爾菲專家問卷之項目,最後將產官學界專家對於實施者與代理實施者之課題重要性做篩選,並計算權重排序其重要性。
最後將理論與文獻、國內外案例分析、研究設計之結果,訂定結論與建議,以供所有權人日後在實施都市更新時實施主體上做選擇。
