勞動檢查制度監督與輔導雇主遵行勞動法令,以維護勞雇雙方之權益,而勞動檢查員即為實際執行勞動檢查制度之人。本研究旨在探討勞動檢查員應具備何種職能項目可幫助其順利執行職務;並探討學生在學時期應如何培養這些能力,期能做為政府機關在選訓勞動檢查員時的依據,及相關系所課程規劃之參考。
本研究首先由文獻整理出十八項勞動檢查員之工作內容,並初步研判各項工作所需的職能項目,據此進行訪談問卷的設計。在訪談部分採質化研究之半結構式訪談法,訪談對象包括十一位勞動檢查員及三位勞動檢查員之主管;另外尚有六位大專院校相關科系之學者受訪,以增加本研究之有效性。最後經整理後得出之研究結果包括以下三點:
一. 勞動檢查員之十四項一般性工作內容,包括:檢查事前分析受檢事業單位之資料、召開檢查前會談、至現場進行勞動檢查、詢問現場相關人員取得檢查資訊、要求現場人員提出必要之資料及相關文件,並做說明、紀錄事業單位提供之資料、召開檢查後會談、製作檢查報告、研判事業單位發生災害的嚴重性,如有必要則通知其停工、研判是否需要聲請檢察官對違反勞動法令者進行搜索、嚴守事業單位之機密,並迴避他人不當請託及有偏頗疑慮之事業單位、宣導主管機關及勞動檢查機構所推行之法令、輔導事業單位安全衛生自動檢查、提供勞資雙方有關勞動法令之諮詢。
二. 勞動檢查員之六項重點職能項目,包括:勞動法規及產業專業知識、誠信正直、分析思考能力、溝通能力、教導他人能力、職權運用能力。及四項次重點職能項目,包括:自我控制能力、自信心、主動性、資訊蒐集能力。
三. 學者對勞動檢查相關系所在課程規劃上的建議,包括安排見習、實習或是案例研習。對學生培養自我能力的建議包括:修習相關專業科目、參與社團/系所活動、準備公務人員高等/普等考試資訊。
Abstract
Labor inspection, which protects the rights and interests of both parties, is used to supervise and guide employers in order to have them obey the labor laws; labor inspector is the person who implements the actual labor inspection system. This study aims to explore what competences inspectors should have so as to help them work successfully. In addition, this study also explores how students cultivate these abilities in school as the standard of choosing labor inspectors for government as well as the reference to course designing for related departments of universities.
This study collects eighteen working contents of labor inspectors from literature review at first, and then designs the interview questionnaire after making a preliminary judgment on the competencies that each work is required. In the interview part, this study employs a qualitative semi-structured interview, and the interviewees include eleven labor inspectors and three managers of the labor inspectors. Also, there are six scholars of related departments of colleges being interviewed in order to increase the utility of this research. At last, the results of this study conclude the following three points:
1. Fourteen general working content for labor inspectors, including: checking the information of business units which are analyzed in advance; having an interview before inspecting; conducting a labor inspection; asking the relevant personnel to acquire information of inspection; asking the personnel to show the necessary information and relevant documents, and explain them; recording the information that the business units offer; having an interview after inspecting; making inspection reports; analyzing the seriousness of the situation and deciding the shut-down timing when the business units have a disaster; judging the necessity of asking the prosecutors to investigate people who violate the labor laws and regulations; keeping the confidential of the business units strictly, and avoiding illegal requests and highly suspect business units; propagating the laws enacted by the government authority and labor inspection organization; guiding the business units through the concept of automatically checking the health and safety; providing a consultation of labor laws and regulations for employers and employees.
2. Labor inspectors’ six main competencies item include: labor laws and professional knowledge, integrity, analitical thinking, interpersonal communication, coaching, accountability. And there are four sub competencies include: self control, self-confidence, initiative, information collecties.
3. The scholars give a suggestion on the course planning of related departments of labor inspection, including arrangements for apprenticeship, internship, or case-study learning and experiencing. Also, the suggestion of cultivating self-ability for students, including: studying the relevant professional subjects; attending clubs / department activities; preparing for the information of the civil service senior / junior examination. |
