本研究所探討為縣市合併升格與縣市區域計畫下之非都市土地使用彈性管制，為在原有體制下，縣市地方政府權力提升，作縣市農村土地使用彈性管制要點。在縣市合併升格與縣市區域計畫法等政策下，農村發展為當下政府重要政策，因此要如何讓農村建設有效發展其作用並不破壞農村原有之自然風貌為探究之主要目標。
本研究以文獻探討法、歸納法探討相關理論、文獻、美國土地使用分區管制探討(何謂土地使用管制、土地使用分區管制表示方式、土地使用分區管制彈性調整機制、土地使用分區管制發展沿革、土地使用分區管制缺點與農村土地產權制度)、台灣非都市土地使用管制制度特質(非都市土地使用管制之內容、非都市土地使用管制之方式、非都市土地之管制特性與非都市土地之管制問題)並解析非都市土地使用彈性管制之意義與必要機制(以縣市區域計畫、桃園區域計畫與農委會水土保持局農村建設個案為例)，以建構農村非都市土地使用彈性管制之法令系統(非都市土地使用彈性管制辦法與某某地區農村土地使用彈性管制要點) 。
The study discusses the non-urban land use flexibility in control under county-city consolidation and the county-city regional planning.In the original system, the development of cities and counties of direction for rural land use flexible control to improve county and city local government authority.At once, rural development becomes the important policy under the policies of county-city consolidation and the county-city regional planning.For this reason, the main purpose is how to availably develop rural construction, besides not destroy the rural original scene.
The study uses literature review and induction approach to discuss the theory, documents, and land use zoning in control in U.S.A.( including what is land use control, zoning, the system of land use flexibility in control, the development in land use, the faults in land use, and the system of rural land property right).And the identity of non-urban land use (including contents, mode, and the problems in non-urban land use).
Moreover, to analysis the purport and essential system of non-urban land use flexibility in control (as county-city regional planning, Tao-Yuan regional planning and the rural construction case by Soil and Water Conservation Bureau for example).
Finally, to build the law system of rural land use flexibility in control ( including Non-urban Land Use Flexibility in Control Act and direction for rural land use flexible control somewhere). |
